【摘要】： 建立社區(qū)矯正制度是我國近期司法體制改革的重要內(nèi)容之一,從2003年7月至今,全國已有28個省(市、區(qū))開展此項工作。如今社區(qū)矯正在全國試點地區(qū)蓬勃發(fā)展,但也遇到了一些發(fā)展的瓶頸,如缺乏法律支撐等現(xiàn)實的問題,社區(qū)矯正立法被提上了議事日程。筆者擬通過對社區(qū)矯正的概念、歷史淵源、可行性和必要性、基本制度及存在法律問題的論述,闡述我國社區(qū)矯正制度順應(yīng)了時代潮流,符合國際刑罰執(zhí)行的趨勢,并必然會極大地推動我國和諧社會的構(gòu)建進程,但也存在著一些問題,需要在試點的基礎(chǔ)上逐步加以改善。
[Abstract]:The establishment of community correction system is one of the important contents of the recent judicial system reform in China. Since July 2003, 28 provinces (municipalities and districts) have carried out this work. Nowadays, community correction has developed vigorously in the pilot areas of China, but it has also encountered some bottlenecks, such as the lack of legal support and other practical problems, so the legislation of community correction has been put on the agenda. By discussing the concept, historical origin, feasibility and necessity, basic system and existing legal problems of community correction, the author expounds that the system of community correction in our country conforms to the trend of the times and conforms to the trend of international penalty enforcement. It will promote the construction process of harmonious society in our country, but there are still some problems, which need to be improved step by step on the basis of pilot project.
