【摘要】：行政執(zhí)法協(xié)同是整體政府治理理念的制度實(shí)踐,它要求不同地域同一政府部門、或同一地域不同政府部門之間應(yīng)避免行政的"碎片化",協(xié)調(diào)配合執(zhí)法以實(shí)現(xiàn)公共行政目的。執(zhí)法協(xié)同機(jī)制建設(shè)是區(qū)域法治建設(shè)的內(nèi)容,也是當(dāng)前深化行政執(zhí)法體制改革的重要問題。在京津冀協(xié)同發(fā)展戰(zhàn)略實(shí)施中,行政執(zhí)法協(xié)同將發(fā)揮引領(lǐng)、規(guī)范和推動(dòng)協(xié)同發(fā)展的制度功能。能否實(shí)現(xiàn)執(zhí)法協(xié)同、執(zhí)法協(xié)同能否堅(jiān)持法治底線,直接影響到京津冀協(xié)同發(fā)展戰(zhàn)略的穩(wěn)定、有序推進(jìn)。目前京津冀區(qū)域執(zhí)法協(xié)同機(jī)制建設(shè)還存在諸多困境,原因主要在于整體政府治理理念與行政執(zhí)法實(shí)踐的疏離,宜從立法的引領(lǐng)和規(guī)范、強(qiáng)化規(guī)劃(頂層設(shè)計(jì))的法定性、執(zhí)法協(xié)同機(jī)制的法治化、行政框架協(xié)議等方面,探索推進(jìn)區(qū)域執(zhí)法協(xié)同機(jī)制建設(shè)。
[Abstract]:The coordination of administrative law enforcement is the institutional practice of the whole concept of government governance, which requires the same government departments in different regions, or different government departments in the same region, to avoid the "fragmentation" of administration and to coordinate and cooperate with law enforcement in order to achieve the purpose of public administration. The construction of law enforcement coordination mechanism is not only the content of regional rule of law construction, but also an important issue to deepen the reform of administrative law enforcement system. In the implementation of the coordinated development strategy of Beijing, Tianjin and Hebei, the coordination of administrative law enforcement will play the institutional function of leading, standardizing and promoting the coordinated development. Whether the coordination of law enforcement can be realized and whether the coordination of law enforcement can adhere to the bottom line of the rule of law directly affects the stability and orderly promotion of the coordinated development strategy of Beijing, Tianjin and Hebei. At present, there are still many difficulties in the construction of law enforcement coordination mechanism in Beijing, Tianjin and Hebei region, mainly due to the alienation between the concept of overall government governance and the practice of administrative law enforcement. It is appropriate to explore and promote the construction of regional law enforcement coordination mechanism from the aspects of legislative guidance and standardization, strengthening the legality of planning (top-level design), legalization of law enforcement coordination mechanism, administrative framework agreement, and so on.
