維柯“詩(shī)性法律”闡釋的原創(chuàng)性及其現(xiàn)實(shí)啟示

【摘要】：維柯的"詩(shī)性法律"闡釋表現(xiàn)為思想領(lǐng)域、研究方法、法律觀的"三重原創(chuàng)性",由此窺見一種遍布世界各民族中的人性光輝,維柯用詩(shī)性的語言預(yù)演了人類"現(xiàn)代大同世界(modern world of nations)的歷程"。"詩(shī)性法律"通過闡釋詩(shī)性智慧揭示了人類文化結(jié)構(gòu)中最本質(zhì)最優(yōu)秀的文化因子,它給予我們一定的現(xiàn)實(shí)啟示:一是中國(guó)社會(huì)調(diào)整機(jī)制需要詩(shī)性的文化親和力和文化創(chuàng)造力;二是中國(guó)的市場(chǎng)經(jīng)濟(jì)體制需要借鑒詩(shī)性文化傳統(tǒng)提升其價(jià)值和諧度;三是在構(gòu)筑"后發(fā)型"、"追趕型"的中國(guó)法制現(xiàn)代化大廈中,需要民族習(xí)慣法的詩(shī)性文化元素和傳統(tǒng)智慧的支撐。
[Abstract]:Vico's interpretation of "poetic law" is manifested in the "triple originality" in the field of thought, research methods and legal view, which reveals the brilliance of human nature in all nations of the world. Vico rehearsed the course of (modern world of nations) in the modern world of Datong in poetic language. Poetic law reveals the most essential and excellent cultural factors in human cultural structure by explaining poetic wisdom. It gives us some practical enlightenment: first, Chinese social adjustment mechanism needs poetic cultural affinity and cultural creativity; Second, China's market economic system needs to learn from the poetic cultural tradition to enhance its value harmony; Thirdly, in the building of "post hairstyle" and "catch-up style", the Chinese legal system needs the support of poetic cultural elements and traditional wisdom of national customary law.
