論古代保辜制度對(duì)現(xiàn)代“刑事和解”的啟示

【摘要】:在我國(guó)古代的刑法制度上,保辜制度是重要的一項(xiàng)法律制度,這一制度的目的在于對(duì)于在人身傷害的案件中受害人的合法權(quán)益進(jìn)行保護(hù),對(duì)加害人所受應(yīng)承受的法律責(zé)任進(jìn)行追究,對(duì)于社會(huì)關(guān)系進(jìn)行整合的制度。在我國(guó)古代社會(huì)中這一制度實(shí)行了兩千多年。保辜制度發(fā)展的成熟期是在唐代,在此時(shí)這一制度得到了系統(tǒng)化和定型化的發(fā)展。在宋代、元代、明代和清代保辜制度獲得了繼續(xù)發(fā)展,在司法和立法等相關(guān)領(lǐng)域也出現(xiàn)了一些變化。該制度本身有其規(guī)律性,并且其思想淵源深刻。所謂刑事和解指的是對(duì)于原有的案件通過(guò)雙方相互協(xié)商并且合作的方式來(lái)對(duì)其進(jìn)行解決和恢復(fù),通常是在刑事訴訟案中,被害人和加害人雙方之間主要是通過(guò)賠償、道歉和認(rèn)罪等方式來(lái)解決矛盾、修復(fù)關(guān)系,從而實(shí)現(xiàn)和解,但是國(guó)家司法機(jī)關(guān)并不對(duì)加害人進(jìn)行相關(guān)刑事的追責(zé)。從20世紀(jì)70年代,西方國(guó)家就已經(jīng)確立、完善刑事和解,促進(jìn)案件的加害人對(duì)于被害人進(jìn)行賠償、撫慰,改造和教育加害人,發(fā)揮司法資源的最大化利用。本文主要針對(duì)中國(guó)古代保辜制度內(nèi)涵,發(fā)展成因進(jìn)行詳細(xì)分析的基礎(chǔ)上,結(jié)合現(xiàn)代刑事和解制度及實(shí)踐狀況,分析了古代保辜制度對(duì)現(xiàn)代“刑事和解”的啟示。
[Abstract]:In the criminal law system of ancient China, the system of protecting Koo is an important legal system. The purpose of this system is to protect the legitimate rights and interests of the victims in cases of personal injury. Investigate the legal responsibility of the perpetrator and integrate the social relationship. This system has been practiced for more than two thousand years in the ancient society of our country. The mature period of the system was in the Tang Dynasty, at which time, the system was systematized and formalized. In the Song Dynasty, Yuan Dynasty, Ming Dynasty and Qing Dynasty, the system of protecting Koo was continued to develop, and there were some changes in related fields such as judicature and legislation. The system itself has its own regularity, and its ideological origin is profound. The so-called criminal reconciliation refers to the settlement and restoration of the original cases through mutual consultation and cooperation between the two sides. Usually, in criminal proceedings, the victims and the perpetrators mainly through compensation. Apologies and confessions are used to resolve conflicts, repair relationships, and achieve reconciliation, but the national judicial authorities do not pursue the perpetrators of related criminal liability. Since the 1970s, the western countries have established and perfected the criminal reconciliation, and promoted the victimizer to compensate, comfort, reform and educate the victim to maximize the use of judicial resources. Based on the detailed analysis of the connotation and causes of the development of the system of protection of the Koo in ancient China, combined with the system of modern criminal reconciliation and its practical situation, this paper analyzes the enlightenment of the system of protecting and protecting the Koo in ancient China to the modern "reconciliation of criminal justice".
