【摘要】：2011年2月19日，省部級(jí)主要領(lǐng)導(dǎo)干部社會(huì)管理及其創(chuàng)新專題研討班在中央黨校舉行，胡錦濤總書記在開班式上做了重要講話，分析了我國(guó)當(dāng)前社會(huì)管理的新形勢(shì)，闡述了加強(qiáng)和創(chuàng)新社會(huì)管理的重要意義，明確了加強(qiáng)和創(chuàng)新社會(huì)管理的指導(dǎo)思想、基本任務(wù)和重點(diǎn)工作，對(duì)新形勢(shì)下加強(qiáng)和創(chuàng)新社會(huì)管理起到了重要的指導(dǎo)作用。本文試圖在對(duì)加強(qiáng)和創(chuàng)新社會(huì)管理進(jìn)行概述式分析的基礎(chǔ)上，提出法治在社會(huì)管理創(chuàng)新中的功能，并通過社會(huì)管理機(jī)制創(chuàng)新的幾個(gè)重點(diǎn)方面對(duì)此進(jìn)行驗(yàn)證，，提出社會(huì)管理五項(xiàng)機(jī)制創(chuàng)新的法治構(gòu)建思路。 文章分為三個(gè)部分，第一章為社會(huì)管理創(chuàng)新的概述，主要介紹社會(huì)管理創(chuàng)新的內(nèi)涵及意義，社會(huì)管理創(chuàng)新的基本理念，社會(huì)管理創(chuàng)新的主要任務(wù)和目標(biāo)等社會(huì)管理創(chuàng)新的基礎(chǔ)內(nèi)容。第二章介紹法治在社會(huì)管理創(chuàng)新中的功能，明確了法治在社會(huì)管理創(chuàng)新中的價(jià)值，分析社會(huì)管理創(chuàng)新法治化的基礎(chǔ)條件，最后提出社會(huì)管理創(chuàng)新的法治原則。第三章主要從社會(huì)管理機(jī)制創(chuàng)新的角度出發(fā)，研究社會(huì)管理機(jī)制創(chuàng)新的法治構(gòu)建。 社會(huì)管理創(chuàng)新還有諸多待研究方面，本文僅選取其中較有代表性的機(jī)制從法治角度加以分析，文章創(chuàng)新之處在于，從法治角度分析加強(qiáng)和創(chuàng)新社會(huì)管理。在對(duì)加強(qiáng)和創(chuàng)新社會(huì)管理的研究中法治角度的選取不僅為加強(qiáng)和創(chuàng)新社會(huì)管理的研究提供了新思路、新途徑，而且使加強(qiáng)和創(chuàng)新社會(huì)管理過程中問題的解決手段具有權(quán)威性；對(duì)加強(qiáng)和創(chuàng)新社會(huì)管理機(jī)制的研究本著現(xiàn)狀—法治缺失—?jiǎng)?chuàng)新的法治思路進(jìn)行研究和分析，有助于透過現(xiàn)象直擊本質(zhì)，有助于形成標(biāo)本兼治的問題解決思路。
[Abstract]:On February 19, 2011, the seminar on social management and innovation of major leading cadres at the provincial and ministerial levels was held at the Central Party School. General Secretary Hu Jintao made an important speech at the opening ceremony and analyzed the new situation of China's current social management. This paper expounds the important significance of strengthening and innovating social management, clarifies the guiding ideology, basic tasks and key work of strengthening and innovating social management, and plays an important guiding role in strengthening and innovating social management under the new situation. Based on the general analysis of strengthening and innovating social management, this paper puts forward the function of rule of law in social management innovation, and verifies it through several key aspects of social management mechanism innovation. This paper puts forward the idea of constructing the rule of law in the innovation of five mechanisms of social management. The article is divided into three parts. The first chapter is an overview of social management innovation, mainly introduces the connotation and significance of social management innovation, the basic concept of social management innovation, The basic content of social management innovation is the main task and goal of social management innovation. The second chapter introduces the function of the rule of law in the social management innovation, clarifies the value of the rule of law in the social management innovation, analyzes the basic conditions of the rule of law in the social management innovation, and finally puts forward the rule of law principle of the social management innovation. The third chapter mainly from the social management mechanism innovation angle, studies the social management mechanism innovation rule of law construction. There are still many aspects to be studied in the innovation of social management. This paper only selects the representative mechanism to analyze it from the angle of rule of law. The innovation of the article lies in the analysis of strengthening and innovating social management from the angle of rule of law. In the study of strengthening and innovating social management, the selection of the angle of rule of law not only provides new ideas and new ways for the study of strengthening and innovating social management, but also makes the means of solving problems in the process of strengthening and innovating social management authoritative. The study of strengthening and innovating the social management mechanism is based on the current situation, the lack of the rule of law and the innovative thinking of the rule of law, which is helpful to attack the essence of the phenomenon directly and to form a solution to the problem with both symptoms and root causes.
