論日本業(yè)主自治法律制度及對我國之借鑒

【摘要】:由于我國城市化起步較晚,導(dǎo)致城市住宅區(qū)業(yè)主自治制度的發(fā)展長期處于萌芽狀態(tài)。隨著我國城市化的高度發(fā)展,尤其是近幾年房地產(chǎn)業(yè)的崛起,城市中增加了大量的多層建筑和新型住宅小區(qū)。關(guān)于業(yè)主自治制度的建設(shè)已經(jīng)存在實際的要求。當(dāng)前我國的《物權(quán)法》雖然初步確立了業(yè)主自治法律制度的框架,但在實踐中所產(chǎn)生的各種法律問題顯示出目前的制度仍不盡人意,無法有效的解決業(yè)主面臨的困難,從而導(dǎo)致業(yè)主的合法權(quán)益受到侵害的事件時有發(fā)生。因此借鑒其它國家制度建設(shè)的經(jīng)驗和做法,改善我國的業(yè)主自治法律制度,對我國物業(yè)管理和城市社會的發(fā)展將會起到重要作用。 本文第一章通過介紹日本業(yè)主自治法律制度發(fā)展的歷史進(jìn)程,了解日本在城市化發(fā)展過程中所產(chǎn)生的業(yè)主自治問題,在日本是如何通過立法予以解決。第二章分析當(dāng)前日本法律關(guān)于業(yè)主自治制度的規(guī)定,展現(xiàn)其對業(yè)主自治法律制度框架的構(gòu)成模式,并且合理借鑒日本的法律成果。第三章針對我國當(dāng)前業(yè)主自治制度所存在的問題,比如業(yè)主的自治意識淡薄,有關(guān)業(yè)主自治的法律規(guī)定過于籠統(tǒng),在實踐中缺乏可操作性,業(yè)主自治機(jī)構(gòu)的法律地位不明確,運作無法得到法律規(guī)范,管理規(guī)約效力低下,政府職能部門對業(yè)主自治制度的長期忽視等,提出改善的建議,以期改善我國的業(yè)主自治法律制度。
[Abstract]:Due to the late start of urbanization in China, the development of owner autonomy system in urban residential areas has been in its infancy for a long time. With the development of urbanization in China, especially the rise of real estate industry in recent years, a large number of multi-storey buildings and new residential areas have been added to the city. About owner self-governing system construction already has the actual request. Although the legal system of owner autonomy has been preliminarily established in our country, various legal problems in practice show that the current system is still unsatisfactory and can not effectively solve the difficulties faced by the owners. As a result, the owner's legitimate rights and interests are violated from time to time. Therefore, it will play an important role in property management and the development of urban society in our country by using the experience and practice of other countries for reference and improving the legal system of owner autonomy in our country. In the first chapter, by introducing the historical process of the development of the legal system of owner autonomy in Japan, we understand the problem of owner autonomy in the process of urbanization in Japan, and how to solve it through legislation in Japan. The second chapter analyzes the current provisions of Japanese law on the owner autonomy system, shows its structure of the legal system of owner autonomy model, and reasonable use for reference of Japanese legal achievements. The third chapter aims at the problems existing in the current owner autonomy system of our country, such as the weak sense of autonomy of the owner, the general legal provisions on the owner autonomy, the lack of operability in practice, and the unclear legal status of the owner autonomy organization. In order to improve the legal system of owner autonomy in our country, the operation can not be regulated by law, the effectiveness of the management statute is low, and the government function department has neglected the owner autonomy system for a long time, and put forward some suggestions to improve the legal system of owner autonomy in our country.
