【摘要】：本文主要研究南京國民政府體育法律制度。從南京國民政府體育法的制定、體育法的執(zhí)行和實施、體育法的適用和體育法的監(jiān)督等方面入手�？偨Y(jié)南京國民政府體育法制的經(jīng)驗教訓(xùn),希望為完善我國體育法制建設(shè)提供一些借鑒經(jīng)驗。 采用文獻(xiàn)資料法、邏輯分析法和比較分析法,以南京國民政府體育法制的建設(shè)為研究對象,從南京國民政府如何制定體育法,如何實施體育法,如何完善體育法制等進(jìn)行全面研究,具體內(nèi)容如下： 首先探究體育法背景,分為三個階段,即綜合法典中有關(guān)體育的規(guī)定、學(xué)校法規(guī)中的體育條款和體育專門法的問世,闡述體育法從不發(fā)達(dá)到發(fā)達(dá)的全過程。 其次,南京國民政府制定了我國第一部體育專門法《國民體育法》。為保證該法實施,南京國民政府又制定了一系列配套法規(guī),使我國體育走向法制化道路。本文主要從學(xué)校體育、社會體育和競技體育三個方面對體育執(zhí)法加以闡述。為了發(fā)展社會體育,南京國民政府專門設(shè)定了“九九體育節(jié)”和“體育實驗區(qū)”制度。在體育法律適用時,例舉了四個案例。為了完善體育法律監(jiān)督系統(tǒng),教育部專門設(shè)立了體育督學(xué)制度。 最后,通過對南京國民政府體育立法、法律實施、執(zhí)法、法律適用和法律監(jiān)督的研究,歸納總結(jié)出國民體育法制具有以下幾個優(yōu)點：重視立法權(quán)威、法律條文從定性到定量、保障婦孺的體育權(quán)利、體制比較完善等。當(dāng)然,南京國民政府體育法也存在一些不足之處。另外,對我國體育法制的建設(shè)提出提出以下四點建議：加強(qiáng)對社會體育的立法、進(jìn)一步加強(qiáng)體育監(jiān)管、制定詳盡的配套法規(guī)和進(jìn)一步落實體育法規(guī)的執(zhí)行。
[Abstract]:This paper mainly studies the sports law system of Nanjing National Government. Starting with the formulation of sports law of Nanjing National Government, the execution and implementation of sports law, the application of sports law and the supervision of sports law, etc. This paper summarizes the experience and lessons of the sports legal system of Nanjing National Government, and hopes to provide some reference experiences for perfecting the construction of sports legal system in China. With the methods of literature, logic analysis and comparative analysis, this paper takes the construction of sports legal system of Nanjing National Government as the research object, from how the Nanjing National Government formulates the sports law, how to carry out the sports law, The specific contents are as follows: firstly, the background of sports law is explored, which is divided into three stages, namely, the sports provisions in the comprehensive code, the sports clauses in the school regulations and the special sports law. This paper expounds the whole process of sports law from underdeveloped to developed. Secondly, the Nanjing National Government formulated the first special sports law of our country, National Sports Law. In order to ensure the implementation of this law, the Nanjing National Government has formulated a series of supporting laws and regulations to make the sports of our country move towards the road of legalization. This paper expounds the law enforcement of sports from three aspects: school sports, social sports and competitive sports. In order to develop social sports, Nanjing National Government specially set up the system of "1999 Sports Festival" and "Sports Experimental Zone". In the application of sports law, cited four cases. In order to improve the sports legal supervision system, the Ministry of Education has set up a sports supervision system. Finally, through the research on the sports legislation, law enforcement, law application and legal supervision of Nanjing National Government, the author concludes that the legal system of national sports has the following advantages: attaching importance to legislative authority, legal provisions from qualitative to quantitative, Safeguard the sports rights of women and children, the system is relatively perfect and so on. Of course, Nanjing National Government sports law also has some deficiencies. In addition, the author puts forward the following four suggestions on the construction of the sports legal system in China: strengthening the legislation on social sports, further strengthening the sports supervision, formulating detailed supporting laws and regulations and further implementing the sports laws and regulations.
