【摘要】：網(wǎng)絡作為開放的公共領(lǐng)域已經(jīng)成為人們討論和傳播公共事件的重要平臺。為了保護正常的言論自由,維護社會秩序穩(wěn)定,法律應當對傳播不實言論的網(wǎng)絡謠言現(xiàn)象予以治理。從加強網(wǎng)絡謠言治理效果的角度看,應當完善相關(guān)法制,加強網(wǎng)絡信息安全管理立法,從嚴責罰制造和傳播網(wǎng)絡謠言的相關(guān)主體。同時,治理網(wǎng)絡謠言應當從根本著手,要切實消除滋生謠言的社會條件,給普通網(wǎng)民提供甄別一般網(wǎng)絡信息與不實網(wǎng)絡言論的標準。
[Abstract]:As an open public domain, network has become an important platform for people to discuss and spread public events. In order to protect the normal freedom of speech and maintain social order and stability, the law should deal with the phenomenon of spreading false speech on the Internet. From the point of view of strengthening the effect of network rumor management, we should perfect the relevant legal system, strengthen the network information security management legislation, and severely punish the relevant subjects who manufacture and spread network rumors. At the same time, to deal with the network rumors, we should start from the root, eliminate the social conditions that breed the rumors, and provide the ordinary Internet users with the standard of discriminating the general network information from the false network statements.
