【摘要】：基坑工程是建設(shè)項(xiàng)目中的重要組成部分,是建設(shè)工程的基礎(chǔ)性工程。而在基坑施工過(guò)程中面臨著眾多安全方面的不確定因素,若發(fā)生安全事故,會(huì)直接影響到后續(xù)工程施工計(jì)劃,并且對(duì)項(xiàng)目整體計(jì)劃也會(huì)產(chǎn)生重大影響。中美兩國(guó)是建筑行業(yè)兩個(gè)不同市場(chǎng)的代表,一個(gè)國(guó)內(nèi)基礎(chǔ)設(shè)施成熟完善,一個(gè)正在展開(kāi)大規(guī)�；A(chǔ)設(shè)施建設(shè)并正走向完善。分析比較中美基坑工程安全法律規(guī)范異同,對(duì)提高我國(guó)建設(shè)工程安全管理水平,完善我國(guó)建設(shè)工程安全生產(chǎn)法律體系有著很大的參考價(jià)值。 本文首先比較了兩國(guó)建筑工程的安全生產(chǎn)法律體系,認(rèn)為我國(guó)應(yīng)當(dāng)在法律的執(zhí)行性、權(quán)責(zé)分配、監(jiān)督控制方面學(xué)習(xí)美國(guó)經(jīng)驗(yàn)。然后對(duì)中美兩國(guó)法律中建筑工程安全生產(chǎn)管理方面進(jìn)行了分析比較,認(rèn)為兩國(guó)監(jiān)督檢查制度以及安全生產(chǎn)教育和培訓(xùn)制度互有特點(diǎn),但我國(guó)應(yīng)當(dāng)加強(qiáng)市場(chǎng)在安全生產(chǎn)管理中的作用,用市場(chǎng)的方法激勵(lì)建筑企業(yè)不斷提供安全生產(chǎn)水平。最后,比較了中美兩國(guó)基坑開(kāi)挖在安全標(biāo)準(zhǔn)規(guī)范方面一些要求,提出我國(guó)應(yīng)當(dāng)編制一部攬括基坑工程各個(gè)方面的基坑工程安全規(guī)范標(biāo)準(zhǔn)集。
[Abstract]:Foundation pit engineering is an important part of the construction project, and is the basic engineering of the construction project. However, in the process of foundation pit construction, there are many uncertain factors in safety. If a safety accident occurs, it will directly affect the construction plan of subsequent projects, and will also have a significant impact on the overall plan of the project. China and the United States are representatives of two different markets in the construction industry, one is mature and the other is developing large-scale infrastructure construction. It is of great reference value to improve the safety management level of construction engineering and perfect the legal system of construction engineering safety in our country by analyzing and comparing the similarities and differences between Chinese and American legal norms of foundation pit engineering safety. This paper first compares the legal systems of construction engineering safety between the two countries, and holds that our country should study the American experience in the aspects of law enforcement, distribution of powers and responsibilities, supervision and control. Then, by analyzing and comparing the aspects of construction engineering safety and production management in the laws of China and the United States, it is concluded that the supervision and inspection systems, as well as the safety education and training systems of the two countries have their own characteristics. However, our country should strengthen the role of the market in the safety production management, and use the market method to encourage the construction enterprises to provide the level of safety production continuously. Finally, the requirements of safety standards for foundation pit excavation in China and the United States are compared, and it is proposed that China should compile a collection of safety standards for foundation pit engineering covering all aspects of foundation pit engineering.
