【摘要】：在建設(shè)"雙一流"背景之下,法律方法論作為一個(gè)獨(dú)立法學(xué)分支學(xué)科的屬性日益提升,2016年度的豐碩成果能夠作為佐證。在理論基礎(chǔ)方面,法律方法論不僅探究了以法教義學(xué)為代表的歷史淵源,還持續(xù)關(guān)注了法治建設(shè)的重大現(xiàn)實(shí)問(wèn)題。在法律方法論的分支學(xué)科中,法律解釋學(xué)強(qiáng)調(diào)了制度完善和綜合解釋方法的運(yùn)用;法律論證理論仍然凸顯著法律修辭的研究成果,并繼續(xù)與中國(guó)法治特點(diǎn)相結(jié)合;法律邏輯學(xué)強(qiáng)調(diào)了作為方法論的形式邏輯。在部門法方法論的研究中,突出的特點(diǎn)是行政法方法論產(chǎn)生了較多成果�；A(chǔ)理論和分支學(xué)科的提升與完善,都充實(shí)著法律方法論作為獨(dú)立學(xué)科的地位。
[Abstract]:Under the background of "double first-class" construction, the attribute of law methodology as an independent branch of law has been promoted day by day. On the theoretical basis, the legal methodology not only explores the historical origin represented by the doctrine of law, but also continues to pay attention to the major practical problems in the construction of the rule of law. In the branch discipline of legal methodology, legal hermeneutics emphasizes the perfection of system and the application of comprehensive interpretation method, the theory of legal argumentation still highlights the research results of legal rhetoric and continues to combine with the characteristics of Chinese rule of law. Legal logic emphasizes formal logic as a methodology. In the research of departmental law methodology, the outstanding characteristic is that the methodology of administrative law has produced many achievements. The promotion and perfection of basic theory and branch discipline enrich the position of law methodology as an independent discipline.
