【摘要】：因私法文化理論基于西方市民社會(huì)實(shí)踐而構(gòu)建,故與我國農(nóng)村實(shí)際情況相去甚遠(yuǎn)。建構(gòu)我國農(nóng)村私法文化必須從我國農(nóng)村實(shí)際出發(fā),圍繞村民自治實(shí)踐,結(jié)合農(nóng)村社會(huì)秩序多元化的特點(diǎn),按照文化變遷的規(guī)律,循序漸進(jìn)地將私法文化理念引入民俗觀念,植入草根精神,逐漸消除私法文化的制度形態(tài)與觀念形態(tài)的沖突。
[Abstract]:Because the cultural theory of private law is based on the practice of western civil society, it is far from the actual situation in our country. To construct the culture of rural private law in our country, we must proceed from the reality of our country, focus on the practice of villager autonomy, combine with the pluralistic characteristics of rural social order, introduce the cultural concept of private law into folk concept step by step according to the law of cultural change. Implanting the grass root spirit gradually eliminates the conflict between the system form and the concept form of the private law culture.
