【摘要】：法治是政治民主的前提和基礎(chǔ),而不是相反。法律的根本屬性是說理,既是說理的依據(jù),又是說理的保障。而說理是民主時代的根本特征,沒有法律就沒有民主。政治民主的底線,是保障人們有權(quán)基于自身利益在公共事務中發(fā)表不同于他人的獨立意見,進而以少數(shù)服從多數(shù)的方式做出決定。政治民主的高度,則取決于國家權(quán)力是否真正受制于人民的權(quán)利,包括一切權(quán)力屬于人民的憲法規(guī)定是否能夠落實,法定的國家權(quán)力運行體制是否穩(wěn)定有效并受到人民群眾的尊重和信任,人民群眾參與公共事務決策的活躍度等。這些問題的解決,最終都取決于法治發(fā)展的水平。
[Abstract]:The rule of law is the premise and foundation of political democracy, not the opposite. The fundamental attribute of law is reasoning, which is both the basis and guarantee of reasoning. Reasoning is the fundamental feature of a democratic age, and there is no democracy without law. The bottom line of political democracy is to ensure that people have the right to express independent opinions in public affairs based on their own interests that are different from others, and then to make decisions in a minority way from the majority. The height of political democracy depends on whether the power of the State is truly subject to the rights of the people, including the fulfilment of constitutional provisions that all powers belong to the people, Whether the legal system of state power is stable and effective is respected and trusted by the masses, and the people's participation in the decision-making of public affairs is active and so on. The solution of these problems ultimately depends on the level of development of the rule of law.
