【摘要】：法治必須追求實(shí)效,法治建設(shè)如何取得實(shí)效是理論和實(shí)踐界面臨的重大課題。目前相關(guān)研究已經(jīng)實(shí)現(xiàn)了從法律實(shí)效向法治實(shí)效的跨越,已經(jīng)從定性走向量化研究階段。皮爾斯的實(shí)效主義思想可以為法治實(shí)效理論及實(shí)踐提供借鑒,實(shí)踐、實(shí)驗(yàn)、檢驗(yàn)是法治實(shí)效得以實(shí)現(xiàn)的三個(gè)重要方面。中國(guó)法治建設(shè)客觀上成效不佳,法治實(shí)效研究尚需深入推進(jìn)。法治評(píng)估既是檢驗(yàn)法治實(shí)效的方法,也是提高法治實(shí)效的一條重要路徑。法治評(píng)估應(yīng)貫穿法治建設(shè)全過(guò)程。在法治評(píng)估的研究和應(yīng)用中,要特別強(qiáng)調(diào)切合實(shí)踐、運(yùn)用實(shí)驗(yàn)方法,并保證公眾參與。
[Abstract]:The rule of law must pursue the actual effect, how to obtain the actual effect in the construction of the rule of law is an important subject facing the theoretical and practical circles. At present, the related research has already realized the leapfrogging from the law actual effect to the rule of law actual effect, has already moved from the qualitative to the quantification research stage. Pierce's theory of effectiveness can be used for reference in the theory and practice of the effectiveness of the rule of law. Practice, experiment and testing are three important aspects in which the effectiveness of the rule of law can be realized. The construction of rule of law in China has not achieved good results objectively, and the research on the effectiveness of the rule of law still needs to be further promoted. The evaluation of rule of law is not only a method to test the effectiveness of rule of law, but also an important way to improve the effectiveness of rule of law. The evaluation of rule of law should run through the whole process of rule of law construction. In the research and application of rule of law assessment, special emphasis should be placed on the practice, the use of experimental methods, and the guarantee of public participation.
