【摘要】：慎刑思想是中國(guó)司法文化的重要組成部分。它起源于封建統(tǒng)治者對(duì)前朝暴政的經(jīng)驗(yàn)總結(jié),滲透于封建社會(huì)的全過(guò)程之中。經(jīng)過(guò)不斷地完善和發(fā)展,到了清朝已經(jīng)成為指導(dǎo)司法機(jī)關(guān)判案定刑的一個(gè)相當(dāng)成熟的司法理念。尤其是在乾隆時(shí)期,以慎刑為指導(dǎo)思想的部駁制度已經(jīng)發(fā)展的非常成熟且在司法活動(dòng)中占據(jù)著重要的地位。今天,司法實(shí)踐中也吸收了慎刑的相關(guān)經(jīng)驗(yàn)理論,展現(xiàn)出審慎的司法態(tài)度�！恶g案新編》是清朝乾隆時(shí)期最為著名的駁案匯編集,被當(dāng)代的法制史研究學(xué)者評(píng)價(jià)為研究清代司法文化不可或缺的史料。它按照《大清律例》的體例進(jìn)行編纂,由司法官員將典型的案例進(jìn)行整理,匯編成冊(cè),希望其后的審案能博采眾長(zhǎng),有所借鑒。人命門主要收錄的是有關(guān)人命的刑事案件,它占據(jù)本書近二分之一的篇幅,是本書中的主要內(nèi)容。生命權(quán)是人最基本的權(quán)利,生命一旦被剝奪就無(wú)法挽回,因此清代司法機(jī)關(guān)在處理有關(guān)人命的案件上更是慎之又慎,是清代慎刑最為直接的表現(xiàn)。本文主要以《駁案新編》人命門的案件為中心來(lái)完成本文創(chuàng)作,此外還參考了《大清律例》、《清實(shí)錄》等清代的法律文件以及一些研究清代慎刑思想的文章和著作。本文的主要研究方法是實(shí)證研究法,并結(jié)合觀察法、文獻(xiàn)研究法、個(gè)案研究法、數(shù)量分析法對(duì)相關(guān)理論與內(nèi)容進(jìn)行歸納與總結(jié),不僅從刑部駁案的程序設(shè)計(jì)上來(lái)看清代的慎刑特點(diǎn),還從司法機(jī)關(guān)處理案件的傾向性以及案件處理結(jié)果的走向這幾個(gè)方面來(lái)分別表現(xiàn)清代的慎刑。
[Abstract]:The thought of careful punishment is an important part of Chinese judicial culture. It originated from the experience of feudal rulers in the former tyranny and permeated the whole process of feudal society. After continuous improvement and development, the Qing Dynasty has become a fairly mature judicial concept to guide the judicial organs. Especially in the Qianlong period, the system of refutation with careful punishment as the guiding ideology has developed very mature and occupies an important position in the judicial activities. Today, the judicial practice also absorbs the relevant empirical theory of careful punishment and shows a prudent judicial attitude. The new edition of refuting cases is the most famous collection of rebuttal cases in the Qianlong period of the Qing Dynasty. It is regarded as an indispensable historical material for the study of the judicial culture of Qing Dynasty by contemporary scholars of legal history. It is compiled according to the style of "Qing Law", and the judicial officials will sort out the typical cases and compile them into a book, hoping that the later cases will be widely used for reference. Human life is the main collection of criminal cases related to human life, it accounts for nearly 1/2 of the book, is the main content of the book. The right to life is the most basic right of human being. Once deprived of life, it is irreparable. Therefore, the judicial organs of the Qing Dynasty are even more cautious in handling cases concerning human life, which is the most direct manifestation of careful punishment in Qing Dynasty. This paper focuses on the case of "refuting the case" and the case of the door of human life. In addition, it refers to the legal documents of the Qing Dynasty, such as the laws of the Great Qing Dynasty and the record of the Qing Dynasty, as well as some articles and works on the thought of careful punishment in the Qing Dynasty. The main research method of this paper is empirical research method, combined with observation method, literature research method, case study method, quantitative analysis method to sum up and summarize the relevant theories and contents. Not only from the point of view of the procedural design of the rebuttal case of the Ministry of torture, but also from the judicial organs to deal with the case tendency and the trend of the outcome of the case in the Qing Dynasty.
