【摘要】：本文所論述的是第二次國內(nèi)革命戰(zhàn)爭時期即土地革命時期,右江革命根據(jù)地刑事法的主要內(nèi)容和刑事司法實踐情況,并在此論述的基礎上分析出右江革命根據(jù)地刑事法的特點和意義。 我國刑法歷史久遠,學者們對于各個歷史時期刑事法律制度的研究也相當充分。在此理論基礎上,本文選取右江革命根據(jù)地刑事法進行研究,可以說是站在巨人肩膀上的眺望。右江革命根據(jù)地刑事法在根據(jù)地建設過程中占據(jù)了重要地位,發(fā)揮了不可小覷的作用,它與革命活動相互配合,使人民群眾有法可依,加強團結(jié),更加有力地打擊地主豪紳、貪官污吏等反動勢力。對它的研究,一方面有助于我們更好地了解右江革命根據(jù)地的真實現(xiàn)狀,還原歷史真實;另一方面,對今后我國刑法改革也具有一定的借鑒作用。 本文在寫作的過程中,為了避免空洞的材料堆砌和盲目的主觀評價,筆者曾到廣西右江地區(qū)進行多次實地田野調(diào)查,通過走訪知情人,查閱檔案館,參觀根據(jù)地舊址等形式,盡可能地搜集第一手材料,開始了對右江革命根據(jù)地刑事法的初探旅程。對革命根據(jù)地的研究,學者們大多從歷史的角度以及政權建設的角度進行,本論文則采取歷史學、政治學、法人類學、法社會學和民族學等多元角度進行根據(jù)地刑事法解讀,通過實地調(diào)查法、文獻整理法、歷史分析法、比較分析法等方法進行資料的搜集整理和文章的撰寫,通過史料研究和對歷史知情人物的走訪,以及同其他革命根據(jù)地刑事法律制度的比較來大體勾勒出當時當?shù)貧v史的原貌。具體而言,全文由引言、正文和結(jié)語三部分內(nèi)容組成。引言部分介紹了該選題的理論意義和實踐價值,并對選題相關領域的研究現(xiàn)狀和筆者寫作本文的研究方法進行了簡要說明,最后指出由于筆者才疏學淺,希望本篇論文能拋磚引玉,期待更多的人加入到該課題的研究工作中來。結(jié)語部分重申本課題的研究價值并指出右江革命根據(jù)地刑法在我國法制建設中的借鑒意義。 正文第一部分,右江革命根據(jù)地刑事法概況。該部分介紹了右江革命根據(jù)地及根據(jù)地刑事法的基本情況。迫于激烈的革命斗爭環(huán)境,右江蘇維埃政府始終把懲治反革命活動作為根據(jù)地刑事法的首要任務,沒有形成獨立完整的刑法典,刑事法規(guī)多散見于一般的法規(guī)條例及命令綱領中,而沒有自成體系。 正文第二部分,右江革命根據(jù)地刑事法的主要內(nèi)容。本部分從刑事法的基本原則、主要罪名及刑罰種類三個方面對右江革命根據(jù)地刑事法主要內(nèi)容進行論述。右江革命根據(jù)地刑事法在實踐過程中形成了廢除肉刑、民族平等、按階級成分定罪量刑等原則;反革命罪是這一時期最重要的罪名,是根據(jù)地刑事法所打擊的重點;在刑罰種類中,迫于根據(jù)地革命需要,死刑的適用相當廣泛。 正文第三部分,右江革命根據(jù)地刑事司法實踐。本部分從司法機關和訴訟制度兩個方面進行探析,最后總結(jié)出刑事司法實踐的基本經(jīng)驗。肅反委員會是右江革命根據(jù)地的主要司法機關,集偵查、審判、執(zhí)行于一身,在司法實踐中形成了依法行使職權、嚴禁刑訊逼供、方便人民群眾的司法原則,積累了明確重點打擊對象、堅持群眾運動與司法機關相結(jié)合、傾聽群眾意見等司法經(jīng)驗。 正文第四部分,右江革命根據(jù)地刑事法的特點。本部分用辯證的方法進行分析,總結(jié)出右江革命根據(jù)地刑事法的主要特點:沒有統(tǒng)一完整的刑法典;沒有獨立的司法機構(gòu);帶有明顯的階級性和強烈的政治性;刑法相對嚴厲,死刑適用廣泛;原則性和靈活性相統(tǒng)一;注重證據(jù),不輕信口供;司法程序不規(guī)范等等。 正文第五部分,右江革命根據(jù)地刑事法的成就和不足。本部分指出右江革命根據(jù)地刑事法在推動革命發(fā)展,鞏固革命根據(jù)地,維護了社會治安,保護根據(jù)地人民利益等方面所取得的成就,并指出由于嚴峻的斗爭環(huán)境右江革命根據(jù)地刑事法所存在的不足。
[Abstract]:This article deals with the main contents and criminal judicial practice of the criminal law of Youjiang revolutionary base area during the second revolutionary civil war period, namely the agrarian revolution period. On the basis of this discussion, the characteristics and significance of the criminal law in Youjiang revolutionary base area are analyzed.
Our country has a long history of criminal law, scholars in the study of criminal legal system in different historical periods is quite sufficient. On the basis of this theory, this paper selects the Youjiang revolution studied according to criminal law, can be said to be overlooking the standing on the shoulders of giants. The criminal law occupies an important position in the construction process of Youjiang revolutionary base that can not be played a role, which cooperates with the revolutionary activities, so that the masses of the people according to the law, strengthen solidarity, more effectively against the landlord, corrupt officials and other reactionary forces. The research on it, we can help us better understand the real situation of Youjiang revolutionary base, to restore the truth of history; on the other hand and some reference for the future reform of criminal law in our country also has.
In the process of writing, in order to avoid the subjective evaluation of empty material stack and blind, so I have been to Guangxi in Youjiang conducted a number of field investigation, visited by insiders, access to archives, visit the site according to the form, to collect first-hand materials as much as possible, start on the journey of criminal law Youjiang revolutionary base of the research. The epilogue reiterated the research value of the topic and points out the significance of criminal law in China's legal construction in Youjiang revolutionary base.
The first part of the text, according to the general situation of Youjiang revolution of criminal law. This part introduces the Youjiang revolutionary base and according to the basic situation of criminal law. Under the fierce revolutionary environment, right Jiangsu wei'ai government always punishing counter revolutionary activities as the primary task of the criminal law, criminal law has not formed the independence and integrity of the criminal. The second part of the revolution in Youjiang according to the main content of criminal law. This part from the basic principles of criminal law, the three aspects of the main charges and penalty types of Youjiang revolution according to the main content of criminal law are discussed. The Youjiang revolutionary base of criminal law in the process of practice form of ethnic equality, abolition of corporal punishment, according to the class composition of conviction and sentencing principles; counter revolutionary crime is the most important in this period is the key to the criminal charges, according to the law against; in penalty, because according to the revolution, the application of the death penalty is quite extensive.
The third part of the Youjiang revolutionary base of criminal judicial practice. This part from two aspects of the judiciary and the litigation system, and finally summed up the basic experience of the practice of criminal justice. According to the Youjiang Revolutionary Committee of elimination of counterrevolutionaries is the principal judicial organ, the set of investigation, trial and execution in a body, in the judicial practice form the exercise of power in accordance with the law, prohibited the inquisition by torture, the judicial principle of the convenience of the people, accumulated a clear focus on the object, adhere to the mass movement and the judicial organ combination, listen to the opinions of the masses and other judicial experience.
In the fourth part, according to the characteristics of Youjiang revolution of criminal law. With the method of dialectical analysis this part, summed up the main features of criminal law of Youjiang revolutionary base: no unified criminal law; no independent judiciary; with obvious class and strong political; relatively strict criminal law, death penalty wide; the unity of principle and flexibility; pay attention to the evidence, Confessions; judicial procedures are not standardized and so on.
The fifth part of the Youjiang revolutionary base the achievements and shortages of criminal law. This part points out that the criminal law in promoting the development of revolution of Youjiang revolutionary base, consolidate the revolutionary base, maintaining social order and protection made according to the aspects of people's interests and achievements, and pointed out that due to the lack of Youjiang revolutionary struggle environment grim existence according to the criminal law.
