【摘要】：近幾年,社會管理創(chuàng)新成為理論和實踐界的研究熱點,黨和政府也在會議和學(xué)習(xí)中不斷地強調(diào)社會管理創(chuàng)新的重要性,全社會開始了一個如何創(chuàng)新社會管理的大討論。在這種背景下,各個領(lǐng)域和學(xué)科的專家學(xué)者也積極地參與其中出謀劃策,學(xué)術(shù)文章和實踐案例如雨后春筍,豐富著社會管理創(chuàng)新這一新興的領(lǐng)域。社會管理的創(chuàng)新現(xiàn)已成為政府體制改革的方向標(biāo),針對于社會管理創(chuàng)新的法治問題進行研究有助于探明社會管理創(chuàng)新中法治相關(guān)的學(xué)理基礎(chǔ)、價值原則、特性和重要性,為社會管理方法創(chuàng)新中的焦點問題提供學(xué)理和制度上的支持；與此同時,社會管理創(chuàng)新的法治問題研究也體現(xiàn)了法學(xué)理論研究在社會實踐問題總的呼應(yīng)和應(yīng)對能力。社會管理創(chuàng)新符合憲法原理,符合以人為本的民主原則,符合人權(quán)內(nèi)容發(fā)展變化的指向和要求,符合權(quán)力制約機制的演變。 法治行政理念的發(fā)展與深化為社會管理創(chuàng)新提供實踐和理論二維的支撐。構(gòu)建有中國特色的社會管理創(chuàng)新體系是我國法治建設(shè)的必然選擇和重要手段。社會管理創(chuàng)新建設(shè)與法治建設(shè)在基本方向與理念上保持一致,并且對法治目標(biāo)的實現(xiàn)具有重要工具價值。依法行政理念的深入人心,已經(jīng)為從法治層面開展社會管理創(chuàng)新奠定了堅實的基礎(chǔ),以憲法至上為原則,開創(chuàng)一個社會管理的新局面已經(jīng)是一個勢在必行的趨勢。社會管理應(yīng)該與時俱進,探索和開創(chuàng)新的管理模式,反思傳統(tǒng)的政府大包大攬的粗放型管理模式,應(yīng)該引進社會組織參與到社會管理中來,讓社會和公民達成良性互動,整體和個體相協(xié)調(diào),總結(jié)和完善一個適合社會發(fā)展和基本國情的社會管理體系。 本文通過四部分內(nèi)容對社會管理創(chuàng)新中的法治問題予以梳理,在前人理論研究的基礎(chǔ)上,先后通過厘清概念、理論分析、問題提出和針對重點問題的建議和對策的研究提出的觀點和看法。我國現(xiàn)階段社會管理創(chuàng)新活動中的法治問題主要表現(xiàn)在觀念層面、立法層面、機構(gòu)架設(shè)層面和法治體系完善等層面,運用分析比較、案例研究和理論推演等方法對上述問題進行逐一研究,希望對社會管理創(chuàng)新活動中的法治問題有所裨益。
[Abstract]:In recent years, social management innovation has become a hot research topic in theory and practice, and the Party and the government have constantly emphasized the importance of social management innovation in meetings and studies. The whole society began a great discussion on how to innovate social management. In this context, experts and scholars from various fields and disciplines also actively participated in the planning and suggestions, academic articles and practical cases have sprung up. The innovation of social management has become the direction of the reform of government system. The research on the rule of law in the innovation of social management can help us to find out the theoretical basis, the principle of value, the characteristics and the importance of the rule of law in the innovation of social management. To provide theoretical and institutional support for the focus issues in the innovation of social management methods; at the same time, The study on the rule of law in the innovation of social management also reflects the general ability of the research of legal theory in social practice. The innovation of social management conforms to the principle of constitution and the democratic principle of people-oriented. In line with the human rights content development and change direction and requirements, in line with the evolution of power restriction mechanism. The development and deepening of the concept of rule of law administration provides practical and theoretical support for social management innovation. It is an inevitable choice and an important means for the construction of the rule of law in China to build a social management innovation system with Chinese characteristics. The construction of rational innovation and the construction of the rule of law are consistent in the basic direction and concept, And it has important tool value for the realization of the goal of rule of law. The idea of administration by law has already laid a solid foundation for carrying out social management innovation from the level of rule of law. It is an imperative trend to create a new situation of social management. Social management should keep pace with the times, explore and create a new management model, and reflect on the traditional extensive management mode of the government. Social organizations should be introduced to participate in social management, so that society and citizens can achieve positive interaction, the whole and individual should be coordinated, and a social management system suitable for social development and basic national conditions should be summed up and perfected. This paper combs the rule of law in the innovation of social management through four parts, on the basis of the previous theoretical research, through the clarification of the concept, theoretical analysis, The views and opinions put forward in the research on the suggestions and countermeasures of the key problems. The rule of law problems in the social management innovation activities in our country at present are mainly manifested at the level of concept, legislation, etc. In order to benefit the rule of law in the innovation of social management, the author uses the methods of analysis and comparison, case study and theoretical deduction to study the above problems one by one at the level of setting up institutions and perfecting the system of rule of law.
