【摘要】：“民者國(guó)之本,食者民之命也”,但當(dāng)食品安全無(wú)法獲得保障時(shí)我們將何處安生?我國(guó)食品安全事故日益頻發(fā),折射出安全制度中的結(jié)構(gòu)性缺陷和問(wèn)題。值得欣慰的是2009年頒布的《食品安全法》,在一定程度上緩解了我國(guó)過(guò)去食品不安全問(wèn)題,其實(shí)施過(guò)程中也取得了一定的成效。2015年我國(guó)對(duì)《食品安全法》80%的條款進(jìn)行了修改,很大程度上改善了食品安全制度中監(jiān)管中多頭執(zhí)法和監(jiān)管權(quán)責(zé)不明等諸多問(wèn)題,但仍存在有不足之處。作為當(dāng)今世界上食品安全法律制度比較發(fā)達(dá)的國(guó)際區(qū)域組織--歐盟,其食品安全法律制度最具有代表性。歐盟用了近半個(gè)世紀(jì)的時(shí)間,建立并完善“從農(nóng)田到餐桌”全流程食品安全規(guī)范,其在制度的構(gòu)建和運(yùn)行已經(jīng)達(dá)到世界較高的水平。筆者期待通過(guò)對(duì)比的方法,將中歐二者的食品安全規(guī)范以及制度進(jìn)行全面梳理、深入研究,闡釋剖析我國(guó)食品安全法律制度問(wèn)題所在,并提出和論證適合我國(guó)國(guó)情的具體對(duì)策建議。在本文中,筆者主要分為三個(gè)部分進(jìn)行論述,第一部分對(duì)國(guó)際食品安全法律制度進(jìn)行大概的介紹。第二部分主要是比較中國(guó)與歐盟食品安全法律制度二者異同之處。以法律體系、食品標(biāo)準(zhǔn)、監(jiān)管、責(zé)任的承擔(dān)、轉(zhuǎn)基因食品安全五個(gè)方面為切入點(diǎn)進(jìn)行比較,明晰我國(guó)目前的問(wèn)題及困境。第三部分,基于前面對(duì)比考察,對(duì)我國(guó)食品安全法律制度進(jìn)行反思性研究,提出完善性的規(guī)范建議。
[Abstract]:"the people are the foundation of the country, and the life of the people is the life of the people." but when food security is not guaranteed, where will we live?. The increasing frequency of food safety accidents in China reflects the structural defects and problems in the safety system. It is gratifying to note that the Food Safety Law promulgated on 2009 alleviates to a certain extent the past food insecurity in China. In 2015, China amended the provisions of the Food Safety Law 80%, which to a large extent improved the many problems in the food safety system, such as the multiple enforcement of the law and the unclear powers and responsibilities of the supervision, and so on. However, there are still some shortcomings. As an international regional organization with relatively developed food safety legal system in the world today, the European Union has the most representative food safety legal system. The EU has spent nearly half a century. The establishment and improvement of "from farmland to dining table" whole process food safety norms, its construction and operation in the system has reached a higher level in the world. The food safety norms and systems of China and Europe are comprehensively combed, deeply studied, the problems of food safety legal system in China are explained and analyzed, and specific countermeasures and suggestions suitable for China's national conditions are put forward and demonstrated. The author mainly divides into three parts to carry on the elaboration, the first part carries on the general introduction to the international food safety legal system. The second part is mainly compares the similarities and differences between China and the European Union food safety legal system. Five aspects of food standards, supervision, responsibility and safety of genetically modified foods are compared to clarify the current problems and dilemmas in China. The third part, based on the previous comparative investigation, This paper makes a reflective study on the legal system of food safety in China and puts forward some suggestions for perfection.
