【摘要】：法律在從立法者創(chuàng)制到國(guó)家實(shí)施的過程中,因?yàn)榱⒎ㄕ吆头勺陨淼母鞣N客觀原因,不可能完全實(shí)現(xiàn)法律的精神和達(dá)到立法者預(yù)期的效果,因此從法的規(guī)范作用來講,法律的作用是存在有限性的。從法的規(guī)范作用探討法律的有限性,是為了發(fā)現(xiàn)、探討和正確認(rèn)識(shí)其有限性,糾正法律的有限性。文章認(rèn)為補(bǔ)償法律局限性的思路有自由裁量主義、嚴(yán)格規(guī)則主義及嚴(yán)格規(guī)則與自由裁量的有機(jī)結(jié)合等原則。從法的規(guī)范作用入手討論法律作用的有限性正是補(bǔ)償法律局限性問題的歷史經(jīng)驗(yàn)總結(jié),成為補(bǔ)償法律局限性的關(guān)鍵所在。
[Abstract]:In the process from legislator creation to national implementation, it is impossible to fully realize the spirit of the law and achieve the expected effect of the legislator because of various objective reasons of the legislator and the law itself. Therefore, from the normative role of law, the role of law is limited. From the normative role of law to explore the limitation of law, is to discover, explore and correctly understand its limitation. The article holds that the idea of compensating for the limitation of law is discretion. The principles of strict rule doctrine and organic combination of strict rules and discretion. From the normative role of the law to discuss the limitation of the legal role is the historical experience summary of the limitation of compensation law. It is the key to compensate for the limitation of law.
