【摘要】：在醫(yī)療刑法中,假設(shè)被害人承諾并非獨立的排除不法事由,也不應(yīng)認定為有效的被害人承諾。在過失犯的審查中,傷害結(jié)果的認定,應(yīng)以《人體損傷程度鑒定標(biāo)準(zhǔn)》為準(zhǔn)。在出現(xiàn)了傷害結(jié)果,但違反注意義務(wù)與傷害結(jié)果之間缺乏必要的關(guān)聯(lián)的場合,即使欠缺被害人的有效承諾,也可排除過失犯的不法。在故意犯的情況下,不能借用違反注意義務(wù)與傷害結(jié)果之間缺乏必要的關(guān)聯(lián)來為當(dāng)事人出罪。如果行為人事先認識到了身體健康法益將受侵害的風(fēng)險,且認識到欠缺被害人承諾來排除該風(fēng)險,則可能成立故意犯的不法。若誤以為存在有效的被害人承諾,則排除故意;若誤以為不存在承諾,則成立未遂。
[Abstract]:In the medical criminal law, it is assumed that the victim's commitment is not an independent reason to exclude wrongfulness, nor should it be regarded as valid victim's commitment. Where the result of the injury occurs, but there is no necessary correlation between the duty of care and the result of the injury, even if there is a lack of effective commitment by the victim, In the case of intentional crime, the lack of necessary connection between the breach of duty of care and the result of injury can not be used to commit a crime for the party concerned. If the perpetrator has realized in advance the risk that the legal benefits of physical health will be infringed, And it is recognized that the lack of victim commitment to exclude the risk may constitute the wrongfulness of intentional crime. If the victim's commitment is mistaken for the existence of valid victim commitment, the intention is excluded; if the victim is mistaken for the absence of the commitment, the attempt is established.
