【摘要】：目的:為我國網(wǎng)絡(luò)售藥監(jiān)管制度的完善提供參考。方法:以"網(wǎng)上藥房""網(wǎng)上藥店""互聯(lián)網(wǎng)藥品""監(jiān)管"為關(guān)鍵詞,檢索2005年1月-2016年1月中國知網(wǎng)和萬方數(shù)據(jù)庫及相關(guān)網(wǎng)站,總結(jié)美、英、德等國在立法、法律規(guī)定和監(jiān)管主體等方面的經(jīng)驗,分析我國網(wǎng)絡(luò)售藥監(jiān)管制度存在的問題并提出建議。結(jié)果與結(jié)論:美、英、德等國網(wǎng)絡(luò)售藥法律完備、立法內(nèi)容相對完善、注重行政監(jiān)管與行業(yè)監(jiān)管結(jié)合。我國網(wǎng)絡(luò)售藥監(jiān)管制度存在立法位階較低,法規(guī)間存在沖突;立法內(nèi)容不完善,很多方面內(nèi)容缺失或規(guī)定模糊;政府部門間執(zhí)法存在沖突,行業(yè)監(jiān)管力量薄弱等問題。建議我國在完善網(wǎng)絡(luò)售藥監(jiān)管制度時應(yīng)制定網(wǎng)絡(luò)售藥的高位階法律,以法律而非法規(guī)、規(guī)章的形式修訂現(xiàn)行法或頒布相關(guān)專門法律;制定明確、可操作的法律并借鑒國外相關(guān)制度(如電子證據(jù)、黑名單制度)以完善法律內(nèi)容;進一步明確各監(jiān)管部門的權(quán)責,積極發(fā)展行業(yè)協(xié)會(如藥學(xué)會等)對網(wǎng)絡(luò)售藥的監(jiān)管。
[Abstract]:Objective: to provide a reference for the improvement of the supervision system of drug sales online in China. Methods: taking "online pharmacy", "Internet drug store" and "supervision" as the key words, we searched China's Zhiwang and Wanfang databases and related websites from January 2005 to January 2016, and summarized the legislation in the United States, Britain, Germany and other countries. This paper analyzes the problems existing in the supervision system of online drug sales in China and puts forward some suggestions. Results & conclusion: in America, Britain, Germany and other countries, the law of online drug sales is complete, the content of legislation is relatively perfect, and the combination of administrative supervision and industry supervision is emphasized. There are some problems in the supervision system of online drug sales in our country, such as low legislative rank and conflict between laws and regulations; imperfect legislative content, lacking or vague provisions in many aspects; conflict of law enforcement among government departments, weak regulatory power in the industry and so on. It is suggested that when our country consummates the supervision system of online drug sales, we should make the high order law of network drug sale, amend the current law or promulgate the relevant special law in the form of laws rather than regulations and regulations, and make it clear. In order to perfect the legal content, the relevant foreign laws (such as electronic evidence, blacklist system) can be used for reference, and the authority and responsibility of each regulatory department should be further clarified, and the supervision of online drug sales by trade associations (such as pharmaceutical association) should be actively developed.
