【摘要】：合同作為一種具有法律效力的文書,語言講究準(zhǔn)確、規(guī)范,但在實(shí)際生活中,由于不合適的語言表述造成歧義并引起糾紛的現(xiàn)象屢見不鮮,因此對(duì)經(jīng)濟(jì)合同語言歧義進(jìn)行研究具有很強(qiáng)的現(xiàn)實(shí)意義。論文以語言學(xué)和統(tǒng)計(jì)學(xué)為主要理論依據(jù),分七章展開:第一章對(duì)國內(nèi)各個(gè)學(xué)者研究經(jīng)濟(jì)合同語言歧義的基本情況進(jìn)行綜述,并表明研究經(jīng)濟(jì)合同語言歧義現(xiàn)象的目的及實(shí)際意義,介紹語料的來源;第二章介紹經(jīng)濟(jì)合同的基本定義、兩種形式、基本特點(diǎn)等,討論了語言歧義的相關(guān)概念,以及產(chǎn)生語言歧義的原因類別;第三章分別從多音詞、多義詞、錯(cuò)別字這三個(gè)方面舉例分析詞匯層面的語言歧義現(xiàn)象;第四章分析因?yàn)榫浞ㄒ蛩匾鸬恼Z言歧義現(xiàn)象,包括成分缺失、指代關(guān)系不明、修飾關(guān)系不明以及連詞使用不當(dāng)四個(gè)方面;第五章分析由語用因素引起的語言歧義,包括標(biāo)點(diǎn)符號(hào)、翻譯和理解(語境)三個(gè)方面。第六章從詞匯、語用以及合同書寫規(guī)范方面對(duì)如何避免因語言歧義引起的經(jīng)濟(jì)合同糾紛進(jìn)行探討第七章總結(jié)文章的內(nèi)容和觀點(diǎn)。通過研究,我們認(rèn)為:雖然很多語言因素都會(huì)引起經(jīng)濟(jì)合同語言歧義,進(jìn)一步導(dǎo)致合同糾紛,但在合同書寫過程中只要正確使用詞匯,注重句子成分之間的語法關(guān)系,重視語境幫助合同語言理解的作用,合同中的歧義語言是可以減少和避免的。
[Abstract]:As a kind of legal instrument, the language of contract is accurate and standardized, but in real life, the phenomenon of ambiguity and dispute caused by inappropriate language expression is common. Therefore, it is of great practical significance to study the ambiguity of economic contract language. Based on linguistics and statistics, the thesis is divided into seven chapters: the first chapter summarizes the basic situation of domestic scholars' research on the ambiguity of economic contract language. It also shows the purpose and practical significance of studying the phenomenon of economic contract language ambiguity and introduces the source of the corpus. Chapter two introduces the basic definition, two forms and basic characteristics of economic contract, and discusses the relevant concepts of language ambiguity. The third chapter analyzes the phenomenon of linguistic ambiguity at lexical level from three aspects: polysyllabic words, polysemous words and misrepresented words. Chapter four analyzes the phenomenon of linguistic ambiguity caused by syntactic factors. The fifth chapter analyzes linguistic ambiguity caused by pragmatic factors, including punctuation, translation and understanding (context). Chapter six discusses how to avoid economic contract disputes caused by language ambiguity in terms of vocabulary, pragmatics and contract writing norms. Chapter 7 summarizes the contents and viewpoints of the article. Through the research, we think that although many language factors will lead to the ambiguity of economic contract language and further lead to contract disputes, but in the process of contract writing, as long as the correct use of vocabulary, pay attention to the grammatical relationship between sentence elements, Pay attention to the role of context to help the understanding of the contract language, the ambiguous language in the contract can be reduced and avoided.
