【摘要】：法律翻譯受到兩種語(yǔ)言不同的國(guó)家文化和法律系統(tǒng)的制約,不能看作是從原語(yǔ)到目的語(yǔ)的簡(jiǎn)單轉(zhuǎn)碼,而是在兩種法律體系之間進(jìn)行轉(zhuǎn)換(Sarcevic,1997:13),其中就涉及到包括法庭文件、公司章程、案例報(bào)告、出生證、合同等不同種類的法律文本。 法律翻譯有著相當(dāng)長(zhǎng)的歷史淵源,對(duì)于人類文明的發(fā)展也起到了不可磨滅的促進(jìn)作用。因此法律翻譯研究不僅在學(xué)術(shù)界受到重視,甚至在政治、經(jīng)濟(jì)和社會(huì)等也擁有舉足輕重的地位。 這篇論文是基于實(shí)踐而寫成的《公司章程》翻譯項(xiàng)目報(bào)告,以目的論為指導(dǎo),通過(guò)對(duì)原文的分析和對(duì)翻譯過(guò)程的剖析,驗(yàn)證了翻譯理論對(duì)于翻譯實(shí)踐的指導(dǎo)意義。 第一章描述了翻譯項(xiàng)目的背景和客戶的要求,并從內(nèi)容、特點(diǎn)和香港和內(nèi)陸法律體系的不同點(diǎn)出發(fā)分析了項(xiàng)目性質(zhì)。介紹了該報(bào)告的目的、意義和局限性,并討論了報(bào)告寫作手法和法律翻譯的相關(guān)文獻(xiàn)。 第二章中介紹了該報(bào)告的目的、意義和局限性,并討論了報(bào)告寫作手法和法律翻譯的相關(guān)文獻(xiàn)。 第三章大致總結(jié)了翻譯工作開始前的準(zhǔn)備工作,包括翻譯工具的使用、翻譯理論的確定以及翻譯進(jìn)度的安排。 第四章從法律翻譯原則的角度出發(fā)詳細(xì)闡述了翻譯過(guò)程,并以《公司章程》的原文為材料,分析了計(jì)算機(jī)輔助翻譯在法律翻譯中的應(yīng)用,大膽推測(cè)了計(jì)算機(jī)輔助翻譯在未來(lái)翻譯行業(yè)中的廣泛應(yīng)用。 第五章是典型問(wèn)題分析,通過(guò)典型例子的分析總結(jié)了法律文件中情態(tài)動(dòng)詞、常用表達(dá)和長(zhǎng)難句的分析和可行的翻譯方法。 最后,文章總結(jié)了翻譯過(guò)程中的學(xué)習(xí)心得,為法律翻譯實(shí)踐提出了一些可行的建議,并大膽展望了計(jì)算機(jī)輔助翻譯的應(yīng)用前景。
[Abstract]:Legal translation is restricted by two different national cultures and legal systems, and cannot be seen as a simple transcoding from the source language to the target language. Instead, the legal translation takes place between the two legal systems and involves, among other things, court documents. Articles of Association, case reports, birth certificates, contracts and other legal texts. Legal translation has a long history and plays an indelible role in promoting the development of human civilization. Economy and society also have a pivotal position. This paper is a practical translation project report. Guided by Skopos theory, this paper verifies the guiding significance of translation theory to translation practice through the analysis of the source text and the translation process. Chapter one describes the background and client requirements of the translation project, and analyzes the nature of the project from its content, characteristics and differences between Hong Kong and the inland legal system. It introduces the purpose, significance and limitations of the report. It also discusses the writing techniques of the report and the relevant literature on legal translation. The second chapter introduces the purpose, significance and limitations of the report, and discusses the writing techniques and the relevant literature on legal translation. Chapter three summarizes the preparatory work before the beginning of translation, including the use of translation tools, the determination of translation theory and the arrangement of translation progress. Chapter 4th elaborates the translation process from the perspective of the principles of legal translation and analyzes the application of computer-assisted translation in legal translation using the original text of the articles of Association as the material. It is inferred that computer-assisted translation will be widely used in the future translation industry. Chapter 5th is an analysis of typical problems. Through the analysis of typical examples, this paper summarizes the analysis of modal verbs, common expressions and long difficult sentences in legal documents and the feasible translation methods. Finally, the paper summarizes the learning experience in the process of translation, puts forward some feasible suggestions for the practice of legal translation, and looks forward to the application prospect of computer-assisted translation.
