【摘要】：中國藝術品市場隨著市場經(jīng)濟的蓬勃發(fā)展而日漸活力膨脹,市場經(jīng)濟環(huán)境吸引大批資金投資進入藝術品交易市場。為保護文化交易市場參與各主體權(quán)利,尤其是藝術作品創(chuàng)作者應有權(quán)益,追續(xù)權(quán)逐漸體現(xiàn)其突出作用。追續(xù)權(quán)是作者從其作品首次銷售后的轉(zhuǎn)賣中分享利益的權(quán)利。追續(xù)權(quán)最早起源于法國,該權(quán)利制度雖然在世界許多范圍內(nèi)建立起來,但對追續(xù)權(quán)的正當性、內(nèi)容、屬性、行使方式、利益提取方式、保護期限性等等問題還具有廣泛爭議。我國在《著作權(quán)法(修改草案)》中首次明確追續(xù)權(quán)的確立,但未有進一步細節(jié)規(guī)范,由此引發(fā)追續(xù)權(quán)制度在我國是否應該引入、如何構(gòu)建的學界討論。本文將討論研究目前世界范圍內(nèi)理論學說、立法范例中追續(xù)權(quán)框架下的具體內(nèi)容范圍,對象種類;在基礎理論架構(gòu)上根據(jù)法理基礎理論以及勞動價值學說、經(jīng)濟市場發(fā)展實際情況,探討追續(xù)權(quán)制度構(gòu)建的正當性以及必要性;比較分析各國追續(xù)權(quán)制度內(nèi)容及特點,在三個層次基礎上尋求我們國家建立追續(xù)權(quán)制度的具體設計,包括制度保護的主體、客體范圍,履行義務的義務主體,追續(xù)權(quán)權(quán)利屬性的綜合性,追續(xù)權(quán)權(quán)益提取比例與方式,以及建立起保證該權(quán)利落實的管理環(huán)節(jié),突出信息獲取的先決條件性與集體管理組織為追續(xù)權(quán)管理方式的優(yōu)勢。
[Abstract]:With the vigorous development of the market economy, the Chinese art market is expanding, and the market economy environment attracts a large number of capital investment into the art market. In order to protect the rights of all subjects in the cultural trading market, especially the rights and interests of the creators of works of art, the right of continuation gradually embodies its prominent role. The right of continuation is the right of the author to share the benefits from the resale after the first sale of his work. The right of continuance originated from France. Although the system has been established in many areas in the world, it is still controversial about the legitimacy, content, attribute, exercise mode, the way of interest extraction, the duration of protection and so on. In the copyright Law (revised draft), the establishment of the right to continue is clearly defined for the first time, but there is no further detailed specification, which leads to the academic discussion on whether the system of the right of continuation should be introduced and how to construct it in our country. This paper will discuss the scope of content and the types of objects under the framework of the current worldwide theoretical theory, legislative paradigm, and the framework of the basic theory, according to the basic theory of legal theory and the theory of labor value. This paper discusses the legitimacy and necessity of the construction of the system of the right to pursue and continues, compares and analyzes the contents and characteristics of the system in various countries, and on the basis of three levels, seeks the concrete design of the establishment of the system of the right of follow-up in our country. Including the subject of system protection, the scope of object, the subject of obligation to fulfill the obligation, the synthesis of the attribute of the right of continuation, the proportion and method of extracting the rights and interests of the right of continuation, and the establishment of management links to guarantee the implementation of the right. The precondition of information acquisition and the advantage of collective management organization are emphasized.
