【摘要】：韓禮德在分析科技語(yǔ)篇時(shí)，從古希臘的方言中借用了雅式(Attic)和土式(Doric)兩個(gè)概念來(lái)分別指代科技話語(yǔ)和日�？谡Z(yǔ)。此后，韓禮德用這一對(duì)概念替代了此前他所提出的一致式和非一致式的概念，規(guī)避了一致式定義模糊的弊端。由于韓禮德同樣指出雅式結(jié)構(gòu)并不只局限于科技語(yǔ)篇，本文試圖在法律語(yǔ)篇特別是法律文本中探討雅式結(jié)構(gòu)。伴隨著全球科技一體化，國(guó)內(nèi)的企業(yè)越來(lái)越傾向于走出國(guó)門與外界尋求合作，外國(guó)投資者也逐漸傾向在中國(guó)設(shè)立企業(yè)尋求共贏，而這些活動(dòng)都離不開(kāi)法律文書(shū)的擬定。鑒于法律文書(shū)涵蓋范圍廣，本文試圖在公司常用法律文書(shū)中探討雅式結(jié)構(gòu)。 本文的整體理論框架建立在韓禮德的語(yǔ)法隱喻理論上，通過(guò)對(duì)選取的六份代表性文書(shū)進(jìn)行定量以及定性的數(shù)據(jù)分析統(tǒng)計(jì)，得出以下結(jié)論：首先，在公司常用法律文書(shū)中存在大量通過(guò)語(yǔ)法隱喻方式實(shí)現(xiàn)的雅式結(jié)構(gòu)，其中十三種語(yǔ)法隱喻的方式在法律文書(shū)中的分布并不平均，，同時(shí)，與土式結(jié)構(gòu)相比，含有雅式結(jié)構(gòu)的公司常用法律文書(shū)詞匯密度高，信息含量大。其次，公司常用法律文書(shū)因?yàn)檠攀浇Y(jié)構(gòu)的存在表現(xiàn)出其獨(dú)有的特點(diǎn)，這些特點(diǎn)同時(shí)也表現(xiàn)出雅式結(jié)構(gòu)在公司常用法律文書(shū)中所呈現(xiàn)的功能，這些功能更好地構(gòu)建了法律語(yǔ)篇。本文根據(jù)韓禮德提出的語(yǔ)言三大元功能理論，也從概念功能、人際功能以及語(yǔ)篇功能等三個(gè)方面探討雅式結(jié)構(gòu)在公司常用法律文書(shū)中的功能。
[Abstract]:Halliday borrowed the concepts of Attic and Doric from the ancient Greek dialect to refer to scientific discourse and daily spoken language respectively. Halliday has since replaced the two concepts he had previously proposed, consistent and non-consistent, avoiding the drawback of vague definitions of consistent definitions. Since Halliday also points out that elegant structure is not limited to scientific and technological discourse, this paper attempts to explore elegant structure in legal texts, especially in legal texts. With the global integration of science and technology, domestic enterprises are more and more inclined to go abroad to seek cooperation with the outside world, and foreign investors are gradually inclined to set up enterprises in China to seek win-win, and these activities are inseparable from the drafting of legal documents. In view of the wide scope of legal documents, this paper tries to explore elegant structure in common legal documents. The whole theoretical framework of this thesis is based on Halliday's grammatical metaphor theory. Through the quantitative and qualitative analysis of the selected six representative instruments, the following conclusions are drawn: first of all, There are a large number of elegant structures realized by grammatical metaphor in the legal documents commonly used by the company. Thirteen grammatical metaphors are distributed unevenly in the legal documents, and at the same time, compared with the local structures, Companies with elegant structure of common legal documents have a high density of vocabulary and information content. Secondly, the common legal documents of the company show their unique characteristics because of the existence of elegant structure, and these characteristics also show the functions of elegant structure in the common legal documents of the company. These functions better construct the legal discourse. Based on Halliday's theory of the three metafunctions of language, this paper also discusses the functions of elegant structure in legal documents of the company from three aspects: conceptual function, interpersonal function and textual function.
