【摘要】：肖像權(quán)作為一項具體的人格權(quán)越來越受到人們的重視。如何判定肖像權(quán)受到了侵害、何種情形屬于肖像權(quán)的合理擴(kuò)張(如卡通、動漫廣告是否屬于肖像權(quán)的合理擴(kuò)張),因侵犯肖像權(quán)而產(chǎn)生的精神撫慰金應(yīng)如何計算。目前我國法律對以上問題均無明確規(guī)定。近日,蘭州市中級人民法院對趙本山肖像權(quán)糾紛一案進(jìn)行了審理并作出判決。該案在理論界和司法實踐中引起了廣泛的爭議。鑒于此,本文將以該案為引子結(jié)合國內(nèi)外法律對肖像權(quán)進(jìn)行研究,以期對司法實踐中同類案件的解決有所幫助。 本文共分為三部分：第一部分主要介紹趙本山肖像侵權(quán)案的基本情況,并歸納總結(jié)出本案的爭議焦點(diǎn)；第二部分主要根據(jù)肖像、肖像權(quán)、精神損害和精神損害賠償?shù)幕纠碚摻Y(jié)合本案的爭議焦點(diǎn)進(jìn)行法理解析,從而總結(jié)出目前我國法律在這方面的缺陷；第三部分主要根據(jù)分析出的缺陷結(jié)合英美法系和大陸法系對肖像權(quán)保護(hù)的規(guī)定及我國學(xué)者的一些觀點(diǎn),根據(jù)我國的實際情況提出具體的完善建議。
[Abstract]:As a concrete personality right , the right of portrait is paid more and more attention . How to judge portrait right is infringed , what kind of situation belongs to the right of portrait right expansion ( such as cartoon , whether cartoon advertisement belongs to portrait right reasonable expansion ) , because of the violation of the right of portrait the mental comfort gold should be calculated . Recently , LanZhou Intermediate People ' s Court has caused extensive controversy in theory and judicial practice . In view of this , this article will study the right of portrait by combining domestic and foreign laws with the aim of this case , with a view to help the solution of similar cases in judicial practice .


This paper is divided into three parts : the first part mainly introduces the basic situation of Zhao Benshan portrait tort , and sums up the dispute focus of the case ;
In the second part , according to the basic theory of portrait , portrait right , mental damage and mental damage compensation , the author summarizes the defects of our country ' s law in this respect .
In the third part , according to the analysis of the defects , combining the Anglo - American law system and the continental law system ' s provisions on the protection of portrait right and the opinions of Chinese scholars , the concrete suggestions are put forward according to the actual situation of our country .
