法律翻譯是翻譯中的高端服務(wù),它主要服務(wù)公民、律師、外資企業(yè)、進(jìn)出口公司等社會(huì)群體,質(zhì)量要求和技術(shù)難度都相當(dāng)高。作為法律語言學(xué)主要研究?jī)?nèi)容之一,法律翻譯在國(guó)內(nèi)和國(guó)際社會(huì)生活中起到非常重要的作用。本報(bào)告以西澳大利亞州《2002年民事責(zé)任法》翻譯為例,探討法律文本在翻譯過程中需注意的事項(xiàng)。本報(bào)告共分五章,第一章是翻譯項(xiàng)目任務(wù)描述,主要介紹文本特點(diǎn)和開展此項(xiàng)任務(wù)的意義。第二章是項(xiàng)目翻譯過程簡(jiǎn)介,對(duì)譯前準(zhǔn)備,實(shí)際翻譯過程以及譯后編輯與校對(duì)進(jìn)行簡(jiǎn)單陳述。論文第三章結(jié)合原文本分析了法律翻譯的基本原則如準(zhǔn)確嚴(yán)謹(jǐn)性、前后一致性、清晰簡(jiǎn)明性、語體規(guī)范性和語言法理化等。第四章是本報(bào)告的重點(diǎn)部分,主要是翻譯案例分析。譯者通過大量的案例分析,從詞匯、句子和語篇三個(gè)層面展開討論。詞匯層面主要是從普通詞匯表法律含義、古舊詞匯、外來詞匯、準(zhǔn)確詞語與模糊詞語和近義詞的并用這五個(gè)維度來進(jìn)行分析;句子層面是從法律一般句式和法律專業(yè)句式這兩個(gè)方面進(jìn)行分析。語篇層面則是從結(jié)構(gòu)轉(zhuǎn)換和語篇翻譯手段的運(yùn)用這兩個(gè)角度進(jìn)行分析。第五章是論文的最后一章,主要是對(duì)本次翻譯實(shí)踐進(jìn)行總結(jié)。譯者總結(jié)并概述了翻譯中遇到的問題和解決方法,同時(shí)對(duì)今后翻...
