【摘要】：隨著我國(guó)經(jīng)濟(jì)發(fā)展進(jìn)入國(guó)際化、商業(yè)化時(shí)代,中國(guó)與非洲國(guó)家經(jīng)濟(jì)往來(lái)逐年增加,國(guó)家與國(guó)家之間的合作日益頻繁,法律翻譯在對(duì)外貿(mào)易和對(duì)外法律交流中的重要性越來(lái)越突出。法律文本的翻譯應(yīng)采取怎樣的翻譯標(biāo)準(zhǔn)與策略?如何用翻譯理論指導(dǎo)翻譯實(shí)踐?本文擬以吐溫萬(wàn)·瑪庫(kù)瓦撰寫(xiě)的《非洲銀行法與實(shí)務(wù)文集》第一章作為實(shí)際案例,以德國(guó)功能主義目的論為理論指導(dǎo),分析法律文本翻譯過(guò)程中遇到的難點(diǎn)并總結(jié)翻譯策略與翻譯方法�！斗侵捭y行法與實(shí)務(wù)文集》是一本關(guān)于非洲銀行法與實(shí)務(wù)的重要學(xué)術(shù)著作。該書(shū)主要介紹了烏干達(dá)銀行法與銀行系統(tǒng)的發(fā)展歷史,分析了烏干達(dá)銀行系統(tǒng)的幾大重要問(wèn)題。第一章《在烏干達(dá)開(kāi)展銀行業(yè)務(wù)的制度框架》介紹了烏干達(dá)銀行的發(fā)展歷史、商業(yè)銀行的發(fā)展環(huán)境、銀行營(yíng)業(yè)執(zhí)照的發(fā)放與撤銷(xiāo)。本翻譯實(shí)踐以德國(guó)功能主義目的論為理論指導(dǎo),力求在準(zhǔn)確無(wú)誤地理解源語(yǔ)文本信息的基礎(chǔ)上,將原文信息準(zhǔn)確地傳遞給目的語(yǔ)讀者。本翻譯實(shí)踐報(bào)告包括四個(gè)部分:翻譯任務(wù)描述、過(guò)程準(zhǔn)備、案例分析和實(shí)踐總結(jié)。翻譯任務(wù)描述包括項(xiàng)目來(lái)源與意義、文本分析;翻譯過(guò)程描述包括譯前準(zhǔn)備、翻譯過(guò)程和譯后審校,譯前準(zhǔn)備包含平行文本的查找、術(shù)語(yǔ)表的建立和翻譯理論的確立;案例分析是本翻譯實(shí)踐報(bào)告的核心部分,該部分分析了法律文本在英譯漢過(guò)程中可能出現(xiàn)的各種問(wèn)題。在目的論指導(dǎo)下,筆者結(jié)合文本特點(diǎn)采取了換序法、增譯法和分譯法,分別從詞語(yǔ)、句法和篇章三個(gè)層面分析了此次翻譯實(shí)踐,以實(shí)現(xiàn)準(zhǔn)確傳遞原文信息的目的;最后一章為翻譯實(shí)踐總結(jié),既客觀指出了此次翻譯實(shí)踐的不足之處,也總結(jié)了此次翻譯實(shí)踐中尚未解決的問(wèn)題。
[Abstract]:As China's economic development enters the international era, the economic exchanges between China and African countries increase year by year, and the cooperation between countries is becoming more and more frequent.Legal translation is becoming more and more important in foreign trade and foreign legal exchange.What translation standards and strategies should be adopted in the translation of legal texts?How to guide translation practice with translation theory?This paper takes the first chapter of the works of African Banking Law and practice written by Twain Wan Marcoua as a practical case, under the guidance of the German functionalist teleology.This paper analyzes the difficulties encountered in the translation of legal texts and summarizes the translation strategies and translation methods. Bank Law and practice in Africa is an important academic work on bank law and practice in Africa.The book mainly introduces the development history of banking law and banking system in Uganda and analyzes several important problems of banking system in Uganda.Chapter one, the Institutional Framework of Banking Business in Uganda, introduces the development history of Uganda Bank, the development environment of commercial banks, and the issuance and revocation of bank business licenses.Guided by the German functionalist Skopos theory, this translation practice tries to accurately transmit the original text information to the target language readers on the basis of an accurate understanding of the source language text information.This translation practice report consists of four parts: translation task description, process preparation, case analysis and practice summary.The translation task description includes the source and meaning of the item, the text analysis, the description of the translation process including the pre-translation preparation, the translation process and the post-translation revision, the pre-translation preparation includes the search of the parallel text, the establishment of the glossary and the establishment of the translation theory.Case study is the core part of this translation practice report, which analyzes various problems that may arise in the process of English-to-Chinese 's legal texts.Under the guidance of Skopos theory, the author adopts the method of changing order, adding the translation method and dividing the translation method to analyze the translation practice from three aspects of word, syntax and text, respectively, in order to achieve the purpose of transmitting the original information accurately.The last chapter is a summary of translation practice, which objectively points out the inadequacies of the translation practice and summarizes the unsolved problems in the translation practice.
