【摘要】：[目的/意義]政府數(shù)據(jù)開放共享是中國大數(shù)據(jù)戰(zhàn)略的核心。政府數(shù)據(jù)的開放共享必須由法律制度予以調(diào)整、推進和保障。原則是法律的要素之一,并且法律原則具有基礎性、穩(wěn)定性,對于中國政府數(shù)據(jù)開放共享法律制度的構(gòu)建必不可少。然而,中國尚無政府數(shù)據(jù)開放的專門立法。為明確政府數(shù)據(jù)開放應循的原則,對于國際組織和不同國家的政府數(shù)據(jù)開放原則進行比較分析,以期借鑒。[方法/過程]首先,闡釋政府數(shù)據(jù)開放的八項原則;其次,評析美國、英國和加拿大的政府數(shù)據(jù)開放原則;最后,提出中國政府數(shù)據(jù)開放的法律原則。[結(jié)果/結(jié)論]中國政府數(shù)據(jù)開放應當遵循公開原則、質(zhì)量原則、及時原則、平等原則、利益平衡原則和安全原則。
[Abstract]:The open sharing of government data is the core of big data's strategy. The open sharing of government data must be adjusted, promoted and guaranteed by the legal system. Principle is one of the elements of law, and the principle of law is basic and stable, which is essential to the construction of the legal system of open data sharing in China. However, there is no specific legislation for the opening up of government data in China. In order to clarify the principles that should be followed in the opening of government data, this paper makes a comparative analysis of the principles of government data openness in international organizations and different countries in order to draw lessons from them. [methods / process] first of all, it explains the eight principles of open government data; secondly, it analyzes the open principles of government data in the United States, Britain and Canada; finally, it puts forward the legal principles of open government data in China. [results / conclusion] the opening of Chinese government data should follow the principles of openness, quality, timeliness, equality, balance of interests and safety.
