【摘要】：范應(yīng)鈴是一位勤政務(wù)實(shí),并且在南宋法律史上占有重要地位的官員。淳熙元年(1174)出生于江西豐城槎村的范氏家族,卒于淳yP三年(1243)。開(kāi)禧元年(1205)中進(jìn)士,先后在江西、廣西、湖南等地為官。在政治立場(chǎng)上,他主張抗戰(zhàn),“恢復(fù)”國(guó)土;在政治作為上,多次平定寇亂、進(jìn)言進(jìn)諫;在處事風(fēng)格上,潔身自好、恪盡職守、體恤百姓;在人際關(guān)系的處理上,與上司、下屬、友人都建立了良好的關(guān)系。宋代重要的法律文書(shū)《名公書(shū)判清明集》收入其大量判詞,內(nèi)容豐富、涉及面廣,范應(yīng)鈴因此廣為人知。范應(yīng)鈴的判詞具有鮮明的時(shí)代特色,集文學(xué)性和實(shí)用性于一身,本文通過(guò)對(duì)其判詞的深入研究,剖析出其重視法理、人情和同情弱者的法律思想。
[Abstract]:Fan Ying-ling is a diligent and pragmatic official who occupies an important position in the legal history of the Southern Song Dynasty. Chun-hee was born in the first year of Cha Village, Fengcheng, Jiangxi Province. He was born in Fan's family in Fengcheng Cha Village, Jiangxi Province. Hunan and other places are officials. From a political standpoint, he advocates the War of Resistance against Japan and "restores" the territory; in political acts, he calms the chaos many times and makes comments; in the style of handling affairs, he is clean, conscientious, conscientious and considerate of the people; and in the handling of interpersonal relations, Good relations have been established with superiors, subordinates, and friends. Pure Brightness, an important legal document in the Song Dynasty, received a large number of judgments, which were rich in content and covered a wide range of areas. Fan Yingling's judgment has distinctive characteristics of the times, which is literary and practical. This paper, through the in-depth study of its judgment, analyzes its legal thought of attaching importance to legal theory, human feelings and sympathy for the weak.
