【摘要】：本文旨在研究庭審話語中被告方的辯護律師對其當事人不禮貌語言的使用。本研究以央視法制節(jié)目《庭審現(xiàn)場》(112期,2014年1月-2016年4月)為語料來源,根據(jù)理論分析與受眾反饋進行篩選,共確定不禮貌語言例證總計14例。首先,對Culpeper(2011)的不禮貌言語行為的定義進行辯證分析,并結合109位受試者(以漢語為母語的流利的語言使用者)對不禮貌言語行為的判斷,形成本文對法庭話語中不禮貌言語的界定:被告方律師對其當事人使用的不禮貌語言是一種言語行為,雖然法官及其他法庭參與人都是庭審交際中的聽話人,但不禮貌話語的指向對象——被告人是不禮貌語言的受話人;此外,依照BrownLevinson(1987)的理性人(Model Person)假設,對(這種)不禮貌言語現(xiàn)象的使用動機進行解釋,同時從法理方面討論不禮貌言語行為與量刑的關系,大多數(shù)的不禮貌言語行為涉及法定或酌定量刑情節(jié),而少部分涉及案外情節(jié)。其次,對法庭話語中辯護律師的不禮貌言語現(xiàn)象進行結構分析,歸納出實現(xiàn)不禮貌語言的四種形式,包括解釋型、說明型、評價型以及混合型,以及不禮貌言語行為的三種分類:積極不禮貌行為、消極不禮貌行為與間接不禮貌行為。然后對法庭話語中常見的三種不禮貌語言行為進行詳細的語料分析。最后,對法庭中不禮貌言語現(xiàn)象的語用功能進行話語分析,分析其在表達憤怒、博取同情、爭取減刑上的作用;為分析不禮貌言語行為對庭審交際的實際影響,采用訪談的形式分析涉及案外情節(jié)的不禮貌言語行為對法官判案的影響。從總體來看,法庭上律師對于當事人采用的不禮貌策略通過強化或弱化量刑情節(jié)或案外情節(jié)的方式達到維護被告人權利,爭取從輕或減輕處罰的目的。因此得出結論:律師在辯論階段對當事人采用的不禮貌言語行為在法庭背景下是一種辯護策略,有助于辯方實現(xiàn)其庭審交際的目的。
[Abstract]:The purpose of this paper is to study the use of the defendant's lawyer in the courtroom discourse on the parties not polite language. In this study, CCTV legal program > (112 < trial period, January 2014 -2016 year in April) were selected as the data sources, according to the theoretical analysis and the feedback of the audience, identified a total of 14 cases of impolite language examples. First of all, the Culpeper (2011) defined the impoliteness of dialectical analysis, combined with the 109 subjects (fluent language users in Chinese) of impolite speech acts of judgment, the court in the discourse of impolite speech definition form: impolite language to use the defendant lawyer is a kind of speech act, although the judges and other people are involved in the court trial of the hearers, but not polite discourse object -- the defendant is not polite language by words; in addition, according to the According to BrownLevinson (1987) (Model Person) of the rational person hypothesis, (this) on impoliteness using motivation to explain, and discuss the relationship between impolite speech acts and sentencing from the legal aspect, most impolite speech acts involving statutory or discretionary circumstances of sentencing, but few involved case plot. Secondly and analyzing the structure of the defense lawyers in courtroom discourse impoliteness, summed up the four forms of rude language, including interpretation, explanation, evaluation type and mixed type, three kinds of classification and impolite speech acts: positive impolite behavior, negative politeness and indirect politeness behavior. Then the three common impolite language behavior in the courtroom discourse analysis of detailed data. Finally, the pragmatic functions of impoliteness in the courtroom discourse analysis, analysis of its expression in Angry, sympathy for the commutation effect; for the actual analysis of the influence of impolite speech acts to trial communication, using the form of an interview case analysis plot involves not polite speech acts to influence judges. Overall, the court for lawyers when not using the thing politeness strategies to maintain the defendant right through the strengthening or weakening of sentencing or the plot, to be given a lighter or mitigated punishment purposes. Conclusion: the lawyer on the parties in the debate is not polite speech act is a kind of defense strategy in courtroom context, help defense to achieve its trial the purpose of communication.
