【摘要】：快遞行業(yè)在近些年飛速發(fā)展,成為當(dāng)代最具競(jìng)爭(zhēng)力的朝陽產(chǎn)業(yè),雖然只經(jīng)歷了三十多年的發(fā)展,但是現(xiàn)在快遞業(yè)已經(jīng)在世界經(jīng)濟(jì)上已經(jīng)占據(jù)重要地位,不但影響著自身企業(yè),更是影響著其它企業(yè)的經(jīng)濟(jì)結(jié)構(gòu)。經(jīng)濟(jì)在發(fā)展,快遞業(yè)在不斷更新突破,如今的互聯(lián)網(wǎng)時(shí)代給快遞業(yè)帶來了更大的機(jī)遇,與此相對(duì)應(yīng),更新的產(chǎn)業(yè)必須對(duì)應(yīng)最新的規(guī)范政策以應(yīng)對(duì)更多的市場(chǎng)風(fēng)險(xiǎn)。中國(guó)進(jìn)入WTO后,第三服務(wù)產(chǎn)業(yè)逐漸成為主要的經(jīng)濟(jì)產(chǎn)業(yè),快遞市場(chǎng)也將進(jìn)入到新的發(fā)展階段,面臨更大的機(jī)遇和挑戰(zhàn)。本文從國(guó)內(nèi)外發(fā)展背景入手,對(duì)中國(guó)的快遞行業(yè)的現(xiàn)狀和前景進(jìn)行研究調(diào)查,根據(jù)市場(chǎng)監(jiān)管法的有關(guān)法律法規(guī)分析我國(guó)快遞業(yè)市場(chǎng)監(jiān)管存在的主要障礙和問題,并且提出來可操作實(shí)行的法律對(duì)策。本文由五章內(nèi)容構(gòu)成:除第一章引言外,第二章是梳理我國(guó)快遞業(yè)的現(xiàn)狀,尤其是我國(guó)快遞業(yè)快速發(fā)展的成因,進(jìn)而分析快遞業(yè)發(fā)展中存在的問題,為論證對(duì)快遞業(yè)進(jìn)行監(jiān)管的必要性做準(zhǔn)備。筆者從快遞業(yè)的發(fā)展過程來透視快遞的發(fā)展動(dòng)態(tài),從發(fā)展過程中研究其暴露的問題,從發(fā)展動(dòng)態(tài)上探究未來可能出現(xiàn)的問題,從而論證快遞監(jiān)管的必要性。對(duì)快遞業(yè)進(jìn)行監(jiān)管能夠保護(hù)公共領(lǐng)域財(cái)產(chǎn)安全;能夠規(guī)范快遞業(yè)市場(chǎng)秩序;保障消費(fèi)者在快遞服務(wù)中的合法權(quán)益�？爝f業(yè)監(jiān)管對(duì)于我國(guó)經(jīng)濟(jì)的發(fā)展也有很大的作用。我國(guó)快遞業(yè)在監(jiān)管方面存在很多問題:首先,我國(guó)快遞行業(yè)的監(jiān)管的法律現(xiàn)狀不容樂觀,主要表現(xiàn)在快遞業(yè)立法和執(zhí)法現(xiàn)狀都不能滿足當(dāng)前飛速發(fā)展的快遞業(yè)需求,立法分散,可操作性不強(qiáng),執(zhí)法環(huán)節(jié)障礙重重。因此,對(duì)快遞業(yè)進(jìn)行監(jiān)管要著重從這些方面入手,這就形成了本文的第三部分內(nèi)容。第四章是國(guó)外快遞行業(yè)的法律監(jiān)管對(duì)于我國(guó)快遞行業(yè)的啟示。通過對(duì)德國(guó)和美國(guó)的快遞行業(yè)的監(jiān)管現(xiàn)狀分析總結(jié),從中獲取對(duì)我國(guó)快遞行業(yè)監(jiān)管的啟示。第五章是對(duì)我國(guó)的快遞行業(yè)市場(chǎng)監(jiān)管提出建議和對(duì)策。針對(duì)前一章提出來的我國(guó)快遞行業(yè)存在的市場(chǎng)監(jiān)管的問題,本章將針對(duì)性的提出來對(duì)于我們快遞行業(yè)市場(chǎng)監(jiān)管法律對(duì)策以及建議。
[Abstract]:Express delivery industry has developed rapidly in recent years and become the most competitive sunrise industry. Although it has only experienced more than 30 years of development, the express delivery industry has already occupied an important position in the world economy. Not only affect their own enterprises, but also affect the economic structure of other enterprises. The economy is developing, the express delivery industry is constantly updating and breaking through, now the Internet era has brought the express delivery industry greater opportunities, corresponding to this. After China's entry into WTO, the third service industry will gradually become the main economic industry, and the express delivery market will also enter a new stage of development. Facing greater opportunities and challenges, this paper from the domestic and foreign development background, the current situation and prospects of the express industry in China to carry out research and investigation. According to the relevant laws and regulations of the market supervision law, this paper analyzes the main obstacles and problems existing in the market supervision of express delivery industry in China, and puts forward the legal countermeasures that can be operated and implemented. This article consists of five chapters: except the introduction of the first chapter. The second chapter is to comb the current situation of China's express industry, especially the causes of rapid development of China's express industry, and then analyze the problems in the development of express delivery industry. In order to prove the necessity of supervision of express delivery industry, the author from the development process of express delivery to perspective the development of express delivery, from the development process to investigate the problems exposed. This paper explores the possible problems in the future from the development trend, and proves the necessity of the express delivery supervision, which can protect the property safety of the public domain. To standardize the market order of express delivery industry; To protect the legitimate rights and interests of consumers in express service. Express industry supervision also plays a great role in the development of China's economy. There are many problems in the regulation of express delivery industry in China: first of all. The current legal situation of the supervision of express delivery industry in China is not optimistic, mainly in the express industry legislation and law enforcement status can not meet the current rapid development of express delivery industry needs, decentralized legislation, the operability is not strong. Therefore, the regulation of express delivery industry should focus on these aspects. This formed the third part of this article. Chapter 4th is the foreign express industry of legal supervision for China's express industry enlightenment. Through Germany and the United States express industry regulatory status quo analysis and summary. Chapter 5th is to put forward suggestions and countermeasures to the market supervision of express industry in China. In view of the problems of market supervision in express delivery industry of our country put forward in the previous chapter. This chapter will be targeted to our express industry market regulatory legal countermeasures and suggestions.
