【摘要】：環(huán)境污染第三方治理作為實(shí)現(xiàn)環(huán)境法、市場(chǎng)秩序法價(jià)值目標(biāo)的重要實(shí)施機(jī)制和制度工具,是落實(shí)污染多元化共治的制度載體。從環(huán)境管理治道變革視角下探討研究環(huán)境污染第三方治理之法理,從制度運(yùn)行層面探討推進(jìn)第三方治理制度之實(shí)施,從法律規(guī)范方面探討第三方治理之不足,從市場(chǎng)準(zhǔn)入條件下探討環(huán)境污染第三方治理之現(xiàn)狀。本文通過法律促導(dǎo)這個(gè)切入點(diǎn),對(duì)這種新的環(huán)境污染治理模式的法律制度基礎(chǔ)進(jìn)行分析,重點(diǎn)探討環(huán)境污染第三方治理在立法、監(jiān)管與執(zhí)法、市場(chǎng)規(guī)制法則等方面存在的法律困境。在借鑒國外先進(jìn)經(jīng)驗(yàn)的基礎(chǔ)上,針對(duì)我國工業(yè)污染第三方治理所存在的法律困境,提出了完善立法,強(qiáng)化環(huán)境監(jiān)管與執(zhí)法力度,構(gòu)建市場(chǎng)規(guī)制法則等對(duì)策。同時(shí),依據(jù)市場(chǎng)規(guī)制法的基本原理,對(duì)構(gòu)建我國工業(yè)污染第三方治理的市場(chǎng)規(guī)制法則進(jìn)行了初步探索,具有深遠(yuǎn)的理論和現(xiàn)實(shí)意義。
[Abstract]:Third party governance of environmental pollution is an important implementation mechanism and system tool to realize the value goal of environmental law and market order law. From the perspective of environmental management and governance reform to explore the third party environmental pollution governance of the legal theory, from the operational level of the system to promote the implementation of the third party governance system. From the aspects of legal norms to explore the deficiencies of third-party governance, from the market access conditions to explore the current situation of third-party governance of environmental pollution. This paper analyzes the legal system foundation of this new environmental pollution control model, and focuses on the third party management of environmental pollution in legislation, supervision and law enforcement. On the basis of the advanced experience of foreign countries, the author puts forward the perfect legislation in view of the legal dilemma of the third party management of industrial pollution in our country. At the same time, according to the basic principle of the market regulation law, the paper makes a preliminary exploration on the construction of the market regulation law of the third party management of industrial pollution in China. It has profound theoretical and practical significance.
