【摘要】：買(mǎi)賣(mài)契約是中國(guó)古代最重要的民事契約之一。為了保障交易安全,保證買(mǎi)賣(mài)之債的實(shí)現(xiàn),官府法令與民間習(xí)慣均要求買(mǎi)賣(mài)雙方尤其是賣(mài)方必須在契約訂立時(shí)明確各類擔(dān)保條款。古文獻(xiàn)資料記載和出土文物資料顯示,我國(guó)古代買(mǎi)賣(mài)契約中常見(jiàn)的擔(dān)保方式為瑕疵擔(dān)保、追奪擔(dān)保、恩赦擔(dān)保和信用擔(dān)保。傳統(tǒng)買(mǎi)賣(mài)之債的擔(dān)保制度,在今天除恩赦擔(dān)保完全失去價(jià)值外,其余則對(duì)現(xiàn)代市場(chǎng)經(jīng)濟(jì)進(jìn)一步培育誠(chéng)信公平理念,仍具有一定的借鑒意義。
[Abstract]:Sale and purchase contract is one of the most important civil contracts in ancient China. In order to ensure the security of the transaction and the realization of the sale debt, both the government decree and the folk custom require both the buyer and the seller, especially the seller, to define all kinds of security clauses when the contract is concluded. According to the records of ancient documents and unearthed cultural relics, the common forms of guarantee in the ancient sale and purchase contract of our country are defect guarantee, recovery guarantee, pardon guarantee and credit guarantee. The traditional guarantee system of debt bought and sold, except forgiving guarantee has lost its value completely today, but it still has certain reference significance for the modern market economy to further cultivate the concept of honesty and fairness.
