【摘要】：收養(yǎng)制度 ,為中國古代社會親屬關(guān)系的一項重要制度 ,在此基礎(chǔ)上 ,收養(yǎng)人與被收養(yǎng)人之間構(gòu)成擬制親屬關(guān)系。在中國古代社會 ,由于收養(yǎng)制度主要是基于家本位、族本位和父系本位而產(chǎn)生 ,故其目的、范圍與基本原則等都與現(xiàn)代收養(yǎng)制度迥異。本文結(jié)合元代收養(yǎng)制度的法律規(guī)定 ,對當時社會生活中的收養(yǎng)關(guān)系及其特點進行了一些初步研究 ,并探討了當時與收養(yǎng)關(guān)系有關(guān)的一些社會問題。
[Abstract]:Adoption system is an important system of kinship relationship in ancient Chinese society. On this basis, the adopter and the adoptee constitute fictitious kinship relationship. In ancient Chinese society, the adoption system was mainly based on the family standard. The purpose, scope and basic principles of the clan standard and paternal standard are different from the modern adoption system. This paper combines the legal provisions of the Yuan Dynasty adoption system. This paper makes some preliminary studies on the adoptive relationship and its characteristics in the social life at that time, and probes into some social problems related to the adoptive relationship at that time.
