【摘要】：羅爾斯的正義理論有許多重要的貢獻,對當代政治哲學有著極其深遠的影響。在羅爾斯的各種理論貢獻中,最重要的貢獻有兩個,一個是他提出了平等主義的正義原則,一個是他重建了社會契約論。正義原則是正義理論圍繞的核心,而社會契約論提供了對正義原則的證明。一個正義觀需要被接受并實行才會有效,要如何讓人們接受這個正義觀,羅爾斯采取了社會契約論的方式。羅爾斯并非把傳統(tǒng)的社會契約論原封不動的拿來構建其理論,傳統(tǒng)社會契約論是建立于十七世紀,是專制時代的產(chǎn)物,他的證成方式不能完全適用于二十世紀的民主社會,羅爾斯勢必要將它修改成能適用于當今的社會。 正義問題是一個重大的理論和實踐問題,尤其是在現(xiàn)如今國內(nèi)、國際秩序的環(huán)境,對正義理論的研究更為迫切。一方面,我們?nèi)狈斫夂桶盐瘴鞣阶杂芍髁x的正義理論,并對理論問題缺乏深刻的理解；另一方面,我們的問題由于其自身的特殊性,又有其特殊性,這就要求我們要在剖析西方的理論問題之上,更要有自己的問題意識。這種立基于中國現(xiàn)實的問題意識在全球化下就是試圖尋求一種全球化下正義問題的中國解決之道。 本論文將分為四個章節(jié),第一章緒論介紹羅爾斯的思想背景以及理論要旨,解析了當時的政治哲學觀念是如何發(fā)展而來的,和羅爾斯為何反對這些這些觀念。 第二章,將詳述羅爾斯正義理論的主要內(nèi)容。其中第一節(jié)說明從原初狀態(tài)推導出正義的兩個原則的過程,第二節(jié)詳細介紹羅爾斯正義理論兩原則,為何羅爾斯會認為它比其他的正義觀要好,它又是如何保障了自由,還有允許公民的不平等條件,但卻又能維持公平。第三節(jié)補充說明羅爾斯想要建立的理想社會。如何以正義的兩個原則建立社會秩序,一個以正義的兩個原則建立的社會是什么樣子的,公民在社會中又會得到什么好處。 第三章,將列舉出數(shù)位學者對他的理論的攻擊,來檢視羅爾斯的契約論存在哪些問題,并補充了羅爾斯在《正義論》之后的著作中,對《正義論》的一些概念所做的修正,結合這些修正后的概念對反對者予以回應。 第四章,試圖通過羅爾斯正義理論的研究成果,進一步探尋其對中國社會發(fā)展的借鑒意義。
[Abstract]:Rawls ' theory of justice has many important contributions , and has profound influence on contemporary political philosophy .

The question of justice is a great theoretical and practical problem , especially in the present domestic and international order environment , it is more urgent to study the theory of justice . On the one hand , we lack understanding and grasp the western liberalism ' s justice theory , and lack a profound understanding of the theoretical problems ;
On the other hand , our problem is due to its own particularity and its particularity , which requires us to analyze the western theoretical problems and have its own problems consciousness . The problem consciousness based on China ' s reality is trying to seek a solution of justice under globalization under globalization .

This thesis is divided into four chapters , the first chapter introduces Rawls ' ideological background and theoretical gist , analyzes how the political philosophy idea of the time develops and why Rawls opposed these concepts .

In the second chapter , the main contents of Rawls ' theory of justice will be described in detail . The first section describes the process of deriving justice from the original state , and the second section details the two principles of Rawls ' justice theory .

In the third chapter , the author lists the attacks on his theory to examine the question of Rawls ' contract theory , and supplements Rawls ' corrections to some concepts of the theory of justice , and responds to the objectors in combination with the revised concepts .

In the fourth chapter , the author tries to explore the significance of its reference to China ' s social development through the research of Rawls ' justice theory .
