【摘要】：我國走出去的企業(yè)是“一帶一路”戰(zhàn)略的主力軍,他們的興衰在極大程度上是海外中國利益的體現(xiàn),海外局勢(shì)復(fù)雜,世界范圍內(nèi)處于一種整體和平、局部動(dòng)蕩的狀態(tài),安全問題事關(guān)海外中國企業(yè)的發(fā)展,由于公權(quán)力保護(hù)有其缺點(diǎn),所以私營安保力量在安保服務(wù)市場(chǎng)的作用對(duì)于境外企業(yè)來說至關(guān)重要,同時(shí),如果由中國自己的安保公司為海外中資企業(yè)提供安保服務(wù),不僅有利于保護(hù)商業(yè)機(jī)密,也是一個(gè)大國實(shí)力和形象的展示。所以,如果我國私營安保企業(yè)在國際私營安保服務(wù)市場(chǎng)中獲得競(jìng)爭(zhēng)力,不但有利于我國私營安保企業(yè)的發(fā)展,也有利于為其他“走出去”企業(yè)保駕護(hù)航。然而現(xiàn)實(shí)是,我國的私營安保企業(yè)不但起步較晚,而且發(fā)展緩慢,尤其是我國國內(nèi)立法沒有針對(duì)私營安保公司的明確規(guī)定,使得該類企業(yè)在國際私營安保服務(wù)市場(chǎng)中競(jìng)爭(zhēng)力較低。私營安保公司本質(zhì)上是公司,但由于其涉外及軍事因素等特殊性,僅靠市場(chǎng)調(diào)節(jié)和行業(yè)自律是不夠的,必須通過有效的法律加以規(guī)范。
[Abstract]:The enterprises going out of our country are the main force of the "Belt and Road" strategy. To a great extent, their rise and fall are the embodiment of the interests of overseas China. The overseas situation is complex, and the world is in a state of overall peace and local turbulence. Security concerns the development of overseas Chinese enterprises. Since the protection of public power has its shortcomings, the role of private security forces in the security services market is of great importance to overseas enterprises. At the same time, If China's own security companies provide security for overseas Chinese companies, it will not only help protect commercial secrets, but also be a demonstration of the strength and image of a big country. Therefore, if China's private security enterprises gain competitiveness in the international private security service market, it is not only conducive to the development of our private security enterprises, but also conducive to the other "go out" enterprises. However, the reality is that the private security enterprises in our country not only started late, but also developed slowly, especially in the absence of explicit provisions in our domestic legislation for private security companies. So that this kind of enterprises in the international private security service market competitiveness is low. Private security company is essentially a company, but because of its particularity of foreign affairs and military factors, it is not enough to rely on market regulation and industry self-discipline, and must be regulated by effective laws.
