【摘要】：加快投資便利化進程,消除投資壁壘,通過雙邊投資協(xié)定(BIT)保護投資者的合法權益是促進"一帶一路"建設的重要舉措。"投資"定義是BIT的核心條款之一,但從國際投資協(xié)定的晚近發(fā)展以及中國近年BIT實踐來看,中國與中亞國家間現(xiàn)存BIT中的"投資"定義在立法體例和具體內容上明顯滯后,不能滿足保護和促進雙邊投資合作的現(xiàn)實需要。中國應基于發(fā)展中資本輸出國的立場,從內容、結構和限制三方面對其中的"投資"定義進行重構。
[Abstract]:Speeding up the process of investment facilitation, eliminating investment barriers and protecting the legitimate rights and interests of investors through bilateral investment agreements (bits) are important measures to promote the construction of "Belt and Road". The definition of "investment" is one of the core provisions of BIT. However, from the recent development of IIAS and China's BIT practice in recent years, the definition of "investment" in the existing BIT between China and the Central Asian countries is obviously lagging behind in terms of legislative style and specific content. China should reconstruct the definition of "investment" from three aspects of content, structure and restriction based on the position of developing capital exporting countries.
