【摘要】：內戰(zhàn)前,尤其是十八世紀晚期和十九世紀早期,奴隸法典伴隨著整個美國下南部地區(qū)和墨西哥灣地區(qū)。這些法典大都表達了同樣的意思：奴隸不是人而是一種“財產”,法律應保護所有者對其“財產”的所有權,同樣也保護白人免受潛在的奴隸威脅。內戰(zhàn)之后,廢奴主義者們基于黑人士兵在保衛(wèi)聯(lián)邦時所作的貢獻,支持黑人獲得解放。在這種情況下,聯(lián)邦憲法頒布第十四條修正案,正是給予黑人公民權并承諾在法律面前,與白人同樣平等；而第十五條修正案通過從法律上給予黑人選舉權。 從奴役中解放出來的黑人奴隸使得南部的經濟模式面臨嚴重的考驗。自由黑人拒絕曾是奴隸制回憶的幫組勞動制,他們更傾向于分成勞動制,但由于被白人農場主極力壓低工資,使得僅有很少自由黑人能堅持下去。 最后,本文得出結論：重建過后,盡管第十四,十五條修正案從法律上終結了黑人作為奴隸的命運,但廣大的黑人在實際中仍沒有同白人一樣的政治權利。在廣大的南方田園地區(qū),分成勞動制代替了內戰(zhàn)前的種植園奴隸制,其基本的社會經濟結構并沒有被完全推翻。大部分的大種植園主即南部社會的上層階級在內戰(zhàn)與重建的嚴酷環(huán)境下幸存了下來,而茫茫黑人大眾仍然是依賴于種植園主,沒有財產的窮苦農民。
