【摘要】： 海事貸款是希臘古典后期海上貿(mào)易主要的融資方式，而海上貿(mào)易是古希臘貿(mào)易的主要形式，所以研究海事貸款問題是占希臘經(jīng)濟(jì)史研究中不可回避的一個(gè)重要方面。本文從原始文獻(xiàn)切入，利用文獻(xiàn)分析的方法，重點(diǎn)探討海事貸款活動(dòng)的運(yùn)作過程及其影響。 全文分為緒論、海事貸款發(fā)展歷程、運(yùn)作過程及對(duì)其評(píng)析四個(gè)部分。 第一部分：前言。界定了論題及簡述了國內(nèi)外研究概況，并說明了本文對(duì)相關(guān)史料的處理方法。 第二部分：發(fā)展歷程。在希臘古典時(shí)期，海事貸款的發(fā)展大致經(jīng)歷了兩個(gè)階段，即一般借貸和冒險(xiǎn)借貸，并簡單分析了各自產(chǎn)生的原因。 第三部分：運(yùn)作過程。海事貸款活動(dòng)大致分為聯(lián)系洽談、訂立協(xié)議、保存協(xié)議、履行協(xié)議、糾紛及其解決方式五個(gè)步驟。 第四部分：評(píng)析。首先，分析了公元前4世紀(jì)海事貸款在雅典盛行的原因�？陀^上看，一方面雅典具有優(yōu)越的地理位置和優(yōu)良的港口設(shè)施，另一方面雅典的社會(huì)環(huán)境有助于海上貿(mào)易的發(fā)展；主觀上看，海事貸款和海上貿(mào)易成為雅典居民謀生的重要手段之一。其次，分析了古希臘海事貸款對(duì)希臘社會(huì)的影響。從經(jīng)濟(jì)上看，保障了希臘城邦社會(huì)生產(chǎn)生活必需品的供應(yīng)，海事貸款的思想及運(yùn)作方式成為現(xiàn)代海上保險(xiǎn)的萌芽；從社會(huì)思想意識(shí)上看，一方面改變了人們對(duì)于財(cái)富的觀念，進(jìn)一步增強(qiáng)了人們對(duì)外開放的意識(shí)；從法制上看，促進(jìn)了國際商業(yè)法規(guī)的萌芽，使商業(yè)誠實(shí)信用的原則誕生并逐漸體現(xiàn)為法律上的概念。
[Abstract]:Maritime loan is the main financing method of maritime trade in the late Greek classical period, and maritime trade is the main form of ancient Greek trade, so the study of maritime loan is an important and unavoidable aspect in the study of Greek economic history. This paper discusses the operation process and influence of maritime loan activity by means of literature analysis. The full text is divided into four parts: introduction, development course, operation process and evaluation of maritime loan. The first part: preface. This paper defines the topic and briefly describes the research situation at home and abroad, and explains how to deal with the related historical materials in this paper. The second part: the course of development. In the classical period of Greece, the development of maritime loans experienced two stages, namely, general lending and risky lending, and the reasons for their emergence were analyzed briefly. The third part: operation process. Maritime loan activities can be divided into five steps: contact negotiation, conclusion of agreement, preservation of agreement, performance of agreement, dispute and its settlement. The fourth part: comment. Firstly, the reasons for the prevalence of maritime loans in Athens in the 4 th century BC were analyzed. Objectively speaking, on the one hand, Athens has a superior geographical location and excellent port facilities; on the other hand, the social environment of Athens is conducive to the development of maritime trade; subjectively, Maritime loans and maritime trade became one of the important means for Athenian residents to earn a living. Secondly, it analyzes the influence of ancient Greek maritime loan on Greek society. From the economic point of view, it has ensured the supply of necessities of life in the Greek city-states, and the idea and operation of maritime loans have become the seeds of modern marine insurance; on the one hand, they have changed people's concept of wealth. It further strengthens people's consciousness of opening to the outside world, promotes the sprout of international commercial laws and regulations from the legal point of view, and makes the principle of commercial good faith come into being and gradually embodies as the concept of law.
