【摘要】： 從近代早期英國(guó)農(nóng)民土地繼承問(wèn)題的角度進(jìn)行研究,揭示出土地繼承給英國(guó)經(jīng)濟(jì)社會(huì)帶來(lái)的影響,從一個(gè)側(cè)面反映了英國(guó)從傳統(tǒng)社會(huì)向現(xiàn)代社會(huì)過(guò)渡的過(guò)程。文章概述了研究的意義和現(xiàn)狀,并重點(diǎn)對(duì)土地的繼承權(quán)進(jìn)行了分析,而且也探究了非繼承人的生活保障問(wèn)題。文章主體分為三個(gè)部分。 第一部分,首先論述了近代早期的土地繼承習(xí)慣,根據(jù)各地區(qū)的習(xí)慣不同,繼承方式也不同;然后分析了土地的繼承問(wèn)題,主要從子女和妻子的角度進(jìn)行論述。第二部分,分析了土地繼承與家庭成員的生活保障問(wèn)題。退出生產(chǎn)領(lǐng)域的父母可以與繼承人之間簽訂贍養(yǎng)協(xié)議、通過(guò)訂立遺囑等方式保障他們的日后生活;非繼承人可以選擇留在家中幫助務(wù)農(nóng)或操持家務(wù)、進(jìn)入教堂擔(dān)任圣職或者進(jìn)入城市等方式保障自己的生活。第三部分,論述了土地繼承對(duì)英國(guó)經(jīng)濟(jì)社會(huì)發(fā)展的影響。近代早期農(nóng)民家庭土地繼承自然造就出一支難以依土地安身立命的群體,從而加速了人口的流動(dòng)性;從家庭內(nèi)部土地的繼承到需要以購(gòu)買的方式繼承,來(lái)揭示出土地市場(chǎng)的發(fā)展;土地的不可分割繼承和可分割繼承導(dǎo)致不同地區(qū)核心家庭與非核心家庭的出現(xiàn)。 最后,文章總結(jié)了近代早期英國(guó)農(nóng)民家庭土地繼承問(wèn)題的現(xiàn)狀,說(shuō)明了這一時(shí)期土地繼承問(wèn)題對(duì)英國(guó)經(jīng)濟(jì)社會(huì)的影響,突出了其在向近代資本主義過(guò)渡時(shí)期的作用。
[Abstract]:From the point of view of the problem of peasant land inheritance in the early modern times, this paper reveals the influence of land inheritance on the British economy and society, and reflects the transition process from the traditional society to the modern society. This paper summarizes the significance and present situation of the research, analyzes the inheritance right of land, and probes into the life security of non-heirs. The main body of the article is divided into three parts. The first part first discusses the land inheritance habits in the early modern times, according to the different habits in different regions, and then analyzes the inheritance of land, mainly from the point of view of children and wives. The second part, analyzes the land inheritance and the family member's life safeguard question. Parents who quit the productive sector can sign maintenance agreements with their heirs to ensure their future lives by making wills, and non-heirs can choose to stay at home to help with farming or to do housework. Enter a church to hold a holy ministry or enter a city to protect one's life. The third part discusses the impact of land inheritance on the economic and social development of Britain. In the early modern times, the peasant family land inheritance naturally created a group of people who could not rest on the land, thus accelerating the mobility of the population, from the inheritance of the land within the family to the need to purchase it. The indivisible and divisible inheritance of land leads to the emergence of nuclear and non-core families in different regions. Finally, the article summarizes the present situation of the peasant family land inheritance in the early modern times, explains the influence of the land inheritance on the British economy and society, and highlights its role in the transition period from modern capitalism to modern capitalism.
