【摘要】：正戰(zhàn)后盟國對(duì)日本戰(zhàn)犯進(jìn)行了大規(guī)模的審判,其中包括設(shè)立在東京的遠(yuǎn)東國際軍事法庭對(duì)甲級(jí)戰(zhàn)犯的審判,以及盟國在亞太地區(qū)設(shè)立的法庭對(duì)乙丙級(jí)戰(zhàn)犯的審判。除此以外,還包括與上述審判不在同一法理體系和框架的日本戰(zhàn)犯審判,如蘇聯(lián)主導(dǎo)的伯力審判和1949年后新中國政府主導(dǎo)的沈陽和太原審判。(1)戰(zhàn)后對(duì)日本戰(zhàn)犯的審判,由于涉及戰(zhàn)爭責(zé)任的確定和國際正義的實(shí)現(xiàn)等"大義名分"問題,一直以來都被視為中日兩國"歷史糾葛"的源頭。相對(duì)而言,學(xué)界對(duì)各盟國主導(dǎo)的乙丙級(jí)戰(zhàn)犯審判的關(guān)注,遠(yuǎn)不如對(duì)甲級(jí)戰(zhàn)犯的國際審判。此外,相對(duì)于中日兩國學(xué)界,西方學(xué)界對(duì)戰(zhàn)后
[Abstract]:After the war, Japan's war criminals were tried on a large scale by allies, including the trial of Class A war criminals by the International military Tribunal for the far East in Tokyo, and the trial of Class B and C war criminals by a court set up by the allies in the Asia-Pacific region. It also includes the trials of Japanese war criminals that are not in the same legal system and framework as the above-mentioned trials, such as the Soviet-led trial of Boli and the post-#date0# trial of Shenyang and Taiyuan, led by the New Chinese Government, and the trial of Japanese war criminals after the war. Because of the issues such as the determination of war responsibility and the realization of international justice, and so on, they have all along been regarded as the source of "historical disputes" between China and Japan. Relatively speaking, scholars have paid close attention to the trials of war criminals of Class B and C led by various allies. It is far worse than international trials of Class-A war criminals. In addition, compared with the academic circles of China and Japan, Western scholars have a very good view of the post-war war.
