寧波江北區(qū)農(nóng)村住房財(cái)產(chǎn)權(quán)抵押困境與對(duì)策研究

【摘要】:在我國(guó),農(nóng)村住房作為農(nóng)民最重要的家庭財(cái)產(chǎn),對(duì)其抵押、擔(dān)保、轉(zhuǎn)讓,政府在黨的十八屆三中全會(huì)上和2014年中央一號(hào)文件中明確提出,要在保障農(nóng)村宅基地用益物權(quán)的基礎(chǔ)上,促進(jìn)農(nóng)村住房財(cái)產(chǎn)權(quán)的靈活使用。農(nóng)村住房財(cái)產(chǎn)權(quán)抵押貸款是我國(guó)農(nóng)戶(hù)獲得資金支持的重要途徑,對(duì)于解決農(nóng)戶(hù)經(jīng)營(yíng)貸款難,農(nóng)村資金短缺,農(nóng)民創(chuàng)業(yè)融資渠道狹窄等問(wèn)題具有重要的現(xiàn)實(shí)意義。寧波江北區(qū)作為城鄉(xiāng)一體化綜合配套改革試點(diǎn)區(qū),在2009年與寧波市信聯(lián)社合作在農(nóng)村范圍內(nèi)推出農(nóng)村住房財(cái)產(chǎn)權(quán)抵押貸款。經(jīng)過(guò)多年的實(shí)踐與探索,寧波江北區(qū)農(nóng)村住房抵押貸款工作日漸成熟,而財(cái)產(chǎn)抵押權(quán)模式也進(jìn)入瓶頸期,工作推進(jìn)難度大。本文以農(nóng)村住房財(cái)產(chǎn)權(quán)為研究對(duì)象,以產(chǎn)權(quán)理論與地租理論為基礎(chǔ),從推進(jìn)城鄉(xiāng)一體化發(fā)展、緩解農(nóng)戶(hù)融資困難及發(fā)展農(nóng)村金融等三個(gè)方面的需要來(lái)闡述農(nóng)村住房財(cái)產(chǎn)權(quán)抵押貸款的必要性。在寧波江北區(qū)農(nóng)村住房財(cái)產(chǎn)權(quán)抵押實(shí)踐工作取得顯著成效的背景下,通過(guò)實(shí)地調(diào)研,深入農(nóng)戶(hù)家庭,了解農(nóng)房抵押農(nóng)戶(hù)的貸款用途、貸款額度、現(xiàn)階段農(nóng)戶(hù)關(guān)于資金的需求、融資的方式及農(nóng)戶(hù)對(duì)農(nóng)房抵押的認(rèn)知程度;繼而系統(tǒng)地闡述寧波江北區(qū)農(nóng)村住房財(cái)產(chǎn)權(quán)抵押實(shí)際運(yùn)作情況,分別從政府支持和制度保障兩方面解讀江北區(qū)農(nóng)村住房財(cái)產(chǎn)權(quán)抵押貸款制度;引用貸款流程圖,形象地說(shuō)明農(nóng)村住房財(cái)產(chǎn)權(quán)抵押貸款的具體操作方法,通過(guò)調(diào)研走訪(fǎng)總結(jié)出江北區(qū)農(nóng)村住房抵押貸款工作面臨五大困境:農(nóng)村住房抵押貸款實(shí)踐與現(xiàn)行法律相沖突,農(nóng)房確權(quán)頒證工作難度大,貸款流程繁瑣、參與的金融機(jī)構(gòu)單一,抵押物處置難,住房抵押貸款配套的保障機(jī)制不健全等問(wèn)題。為更好地推進(jìn)農(nóng)村住房抵押貸款,依據(jù)江北區(qū)農(nóng)村住房抵押貸款實(shí)踐中面臨的困境,本文提出以下建議:從頂層設(shè)計(jì)來(lái)完善法律政策,創(chuàng)新農(nóng)村金融體系,完善產(chǎn)權(quán)抵押交易市場(chǎng);通過(guò)優(yōu)化抵押貸款模式提出簡(jiǎn)化貸款程序、擴(kuò)大貸款用途和加強(qiáng)農(nóng)民技能培訓(xùn)等方面的便民服務(wù),引入擔(dān)保公司,創(chuàng)新農(nóng)房抵押擔(dān)保機(jī)制,規(guī)避信貸風(fēng)險(xiǎn)和法律風(fēng)險(xiǎn);創(chuàng)新住房財(cái)產(chǎn)權(quán)抵押處置機(jī)制,通過(guò)擴(kuò)大受讓人的范圍,促進(jìn)抵押權(quán)的實(shí)現(xiàn),調(diào)動(dòng)金融機(jī)構(gòu)的積極性;推行宅基地使用權(quán)租賃制度來(lái)保障宅基地用益物權(quán);最后從建立抵押物價(jià)值評(píng)估機(jī)制、完善風(fēng)險(xiǎn)分擔(dān)機(jī)制、加快建設(shè)農(nóng)村信用體系以及健全農(nóng)村社會(huì)保障體系四個(gè)方面來(lái)完善農(nóng)村住房財(cái)產(chǎn)權(quán)抵押貸款的配套保障機(jī)制,推動(dòng)農(nóng)村住房財(cái)產(chǎn)權(quán)抵押貸款工作全面鋪開(kāi)。
[Abstract]:In China, rural housing, as the most important family property of farmers, was clearly stated by the government in the third Plenary session of the 18th CPC Central Committee and in the first document of the Central Committee in 2014. We should promote the flexible use of rural housing property rights on the basis of protecting rural homestead usufruct. The mortgage loan of rural housing property right is an important way for farmers to get financial support in our country. It is of great practical significance to solve the problems such as the difficulty of farmers' operating loans, the shortage of rural funds and the narrow channels of farmers' pioneering financing. Ningbo Jiangbei District, as a pilot area of integrated reform of urban and rural integration, launched a mortgage loan for rural housing property rights in the rural area in 2009, in cooperation with Ningbo Xinlian News Agency. After many years of practice and exploration, the rural housing mortgage loan work in Jiangbei District of Ningbo has matured day by day, and the mode of property mortgage has also entered the bottleneck period, so it is difficult to advance the work. This article takes the rural housing property right as the research object, takes the property right theory and the land rent theory as the foundation, promotes the urban-rural integration development, This paper expounds the necessity of mortgage loan of rural housing property right in order to alleviate the difficulty of farmers' financing and the need of developing rural finance. Under the background that the practice of rural housing property right mortgage in Jiangbei District of Ningbo has achieved remarkable results, through the field investigation, we can go deep into the families of farmers, understand the use of the loans, the amount of loans, and the demand of farmers for funds at this stage. The way of financing and farmers' cognition of agricultural house mortgage, and then systematically expound the actual operation of rural housing property right mortgage in Jiangbei District, Ningbo. It explains the mortgage loan system of rural housing property right in Jiangbei District from the two aspects of government support and system guarantee, and cites the loan flow chart to illustrate the concrete operation method of the mortgage loan of rural housing property right. Through the investigation and visit, it concludes that the rural housing mortgage loan work in Jiangbei District faces five difficulties: the practice of rural housing mortgage loan conflicts with the current law, the certification of the right to confirm the rural housing is difficult, the loan process is cumbersome, and the participating financial institutions are single. Mortgage is difficult to dispose of, housing mortgage supporting security mechanism is not perfect and so on. In order to promote the rural housing mortgage loan better, according to the dilemma in the practice of rural housing mortgage loan in Jiangbei District, this paper puts forward the following suggestions: to perfect the law and policy from the top level design, to innovate the rural financial system, Perfect the property right mortgage transaction market, simplify the loan procedure by optimizing the mortgage loan mode, expand the loan use and strengthen the convenient service for farmers' skill training, introduce the guarantee company, innovate the guarantee mechanism of the agricultural house mortgage, To avoid credit risk and legal risk, to innovate the mechanism of mortgage disposal of housing property right, to expand the scope of transferee, to promote the realization of mortgage, and to mobilize the enthusiasm of financial institutions. To protect the usufruct right of the homestead, finally to establish the evaluation mechanism of mortgage value, perfect the risk-sharing mechanism, and implement the lease system of homestead use right to protect the usufruct right of homestead. Accelerate the construction of rural credit system and improve the rural social security system to improve the rural housing property rights mortgage loan supporting security mechanism to promote the rural housing property rights mortgage loan work.
