【摘要】：我國經(jīng)濟的飛速發(fā)展和城鎮(zhèn)化的不斷推進離不開土地的支撐。近年來,全國大量農(nóng)村土地被占用,由此產(chǎn)生眾多的失地農(nóng)民。能否處理好失地農(nóng)民問題,直接關(guān)系到社會的安定穩(wěn)定和經(jīng)濟的可持續(xù)發(fā)展�；莅部h按照“一縣一城、全境開拓”的思路,加快推進工業(yè)化和城市化進程,致力于打造“泉州北翼新城”。目前該縣被征收土地超過30%的農(nóng)民已達(dá)到21萬。如何保障失地農(nóng)民的利益,幫助他們安居樂業(yè)是當(dāng)?shù)卣叫杞鉀Q的問題。本文以惠安城鎮(zhèn)化發(fā)展以及土地征用情況為背景,研究失地農(nóng)民面臨的問題。通過調(diào)查和訪談,系統(tǒng)的了解失地農(nóng)民面臨生活支出增加、就業(yè)困難、社會保障水平不高、生存環(huán)境遭受破壞、理財觀念缺乏、子女教育方面壓力大等一系列問題。深入分析導(dǎo)致失地農(nóng)民面臨困境的主要原因在于土地所有權(quán)不清、法律法規(guī)不完備、土地征用程序不規(guī)范、補償標(biāo)準(zhǔn)不合以及失地農(nóng)民方面原因等。在總結(jié)國內(nèi)外關(guān)于失地農(nóng)民問題的經(jīng)驗和啟示的基礎(chǔ)上,立足我國法律法規(guī)的現(xiàn)狀和惠安縣經(jīng)濟社會發(fā)展?fàn)顩r,提出保護惠安縣失地農(nóng)民權(quán)益的行之有效的措施,即明確土地產(chǎn)權(quán),制定合理的土地征收補償標(biāo)準(zhǔn),健全失地農(nóng)民社會保障制度,引導(dǎo)失地農(nóng)民就業(yè),探索土地補償方式,提供法律援助等。
[Abstract]:In recent years, a large number of rural land has been occupied in China, which has resulted in a large number of land-losing farmers. It is directly related to social stability, stability and sustainable economic development. Huian County speeds up the process of industrialization and urbanization in accordance with the idea of "one county, one city, and the development of the whole territory." Committed to "Quanzhou North Wing New City." the county has been expropriated more than 30% farmers have reached 210,000. How to protect the interests of land-losing farmers, It is an urgent problem for the local government to help them live and work in peace and contentment. Based on the development of urbanization and land expropriation in Huian, this paper studies the problems faced by landless farmers. Systematically understand that landless farmers face increased living expenses, difficult employment, low level of social security, destruction of their living environment, lack of financial management concept, A series of problems, such as the pressure on children's education, are mainly caused by the lack of clear ownership of land, incomplete laws and regulations, and irregular procedures of land requisition. On the basis of summing up the experience and enlightenment of the problem of land-lost farmers at home and abroad, based on the current situation of laws and regulations of our country and the economic and social development situation of Huian County, The effective measures to protect the rights and interests of landless farmers in Huian County are put forward, that is, defining the land property right, formulating reasonable land expropriation compensation standard, perfecting the social security system of the land-lost farmers, guiding the landless peasants to obtain employment, and exploring the land compensation methods. Provide legal aid, etc.
