【摘要】：當(dāng)下我國的法治實踐存在立法缺少博弈、法律適用屢被民眾規(guī)避的現(xiàn)象,原因與傳統(tǒng)中國以家庭和倫理為基礎(chǔ)的差序結(jié)構(gòu)有關(guān),其一方面導(dǎo)致社會團(tuán)體缺乏組織力,無法為立法注入多方力量博弈的基礎(chǔ),另一方面致使法律以差異而非平等為其核心精神,同一規(guī)則難以被一體遵守。實現(xiàn)法治中國需要破除傳統(tǒng)社會結(jié)構(gòu)性的羈束,一是要堅持發(fā)展市場經(jīng)濟(jì)促進(jìn)社會結(jié)構(gòu)轉(zhuǎn)型,通過吸納公民參與立法、吸收情理入法以及認(rèn)可多元化規(guī)則等路徑并結(jié)合公民訓(xùn)練的方式以養(yǎng)成民眾遵守規(guī)則的習(xí)慣,實現(xiàn)形式法治;二是要通過約束權(quán)力行使、提升社會團(tuán)體的組織力和培育第三方力量等路徑形成立法的相互制衡,為良法之治創(chuàng)造根基,達(dá)成實質(zhì)法治。
[Abstract]:In the current practice of rule of law in our country, there is a lack of game in legislation and the phenomenon that the application of law is evaded by the public. The reason is related to the traditional Chinese differential order structure based on family and ethics, which on the one hand leads to the lack of organizational power of social groups. It is impossible to inject the basis of multi-force game into the legislation, on the other hand, it is difficult to abide by the same rule because the law takes difference rather than equality as its core spirit. To achieve the rule of law in China, we need to break down the structural constraints of the traditional society. First, we must persist in developing the market economy to promote the transformation of the social structure, by involving citizens in the legislation. We should absorb the rational approach and recognize the pluralistic rules, and combine the way of citizen training in order to develop the habit of the people to abide by the rules, and to realize the formal rule of law; the second is to exercise the power by restricting the exercise of power. In order to create the foundation for the governance of good law and to achieve the substantial rule of law, the ways of enhancing the organization of social organizations and cultivating third party forces form the mutual checks and balances of legislation.
