【摘要】： 隨著經(jīng)濟(jì)全球化進(jìn)程的加快,我國(guó)為了盡快建立起與市場(chǎng)經(jīng)濟(jì)相適應(yīng)的法律體系,以國(guó)家強(qiáng)制力為后盾,大量移植經(jīng)濟(jì)發(fā)達(dá)國(guó)家和地區(qū)的法律,迅速建立起了一套相對(duì)比較先進(jìn)的法律制度。然而,通過(guò)移植而建立起來(lái)的法律在一定程度上因缺乏必要的本土適應(yīng)性不易甚至不為人們所普遍接受,也無(wú)法成為人們的行為規(guī)范。在中國(guó)的法治建設(shè)中法律的本土適應(yīng)性以及能夠?yàn)槠渥龀鼍薮筘暙I(xiàn)的本土資源越來(lái)越受到人們的關(guān)注。鄉(xiāng)規(guī)民約作為中國(guó)本土資源的重要組成部分,同樣受到了充分的重視,也受到了一些專家、學(xué)者的廣泛研究。 前人對(duì)鄉(xiāng)規(guī)民約的研究主要是從傳統(tǒng)文化的視角進(jìn)行的,并取得了一定的成果。但很少有人從經(jīng)濟(jì)因素、文化因素、政治因素、社會(huì)因素全方位對(duì)鄉(xiāng)規(guī)民約進(jìn)行更深刻的剖析。本文用系統(tǒng)論的方式對(duì)鄉(xiāng)規(guī)民約存在的合理性進(jìn)行了全面的論述,并在研究鄉(xiāng)規(guī)民約的法治功能和鄉(xiāng)規(guī)民約與國(guó)家法的互動(dòng)方面運(yùn)用了法經(jīng)濟(jì)學(xué)成本效益分析方法和哈特的規(guī)則理論。以此來(lái)闡明鄉(xiāng)規(guī)民約在中國(guó)法治現(xiàn)代化建設(shè)中的重要性,并對(duì)如何消解鄉(xiāng)規(guī)民約與國(guó)家法的沖突,鄉(xiāng)規(guī)民約如何在立法及司法層面向國(guó)家法轉(zhuǎn)化進(jìn)行了論述。說(shuō)明了我們需要重視的鄉(xiāng)規(guī)民約是何種意義上的鄉(xiāng)規(guī)民約。
[Abstract]:With the acceleration of the process of economic globalization, in order to establish a legal system adapted to the market economy as soon as possible, our country, backed by national coercive power, has transplanted a large number of laws from developed countries and regions. A relatively advanced legal system was quickly established. However, to some extent, the laws established by transplantation are not easy to be accepted or even accepted by people due to the lack of necessary local adaptability, nor can they become the norm of people's behavior. People pay more and more attention to the local adaptability of law and the local resources which can make great contributions to the construction of Chinese rule of law. As an important part of the local resources of China, the rural regulations have also been paid full attention to, and have also been extensively studied by some experts and scholars. The previous researches on the rural rules and regulations have been carried out mainly from the perspective of traditional culture. And achieved certain results. But few people from the economic factor, the cultural factor, the political factor, the social factor omnidirectional carries on the deeper analysis to the township rule. In this paper, the rationality of the existence of rules and regulations in rural areas is comprehensively discussed in the way of system theory. The author also applies the cost-benefit analysis method of law and economics and Hart's rule theory to study the function of rule by law of rural regulations and the interaction between rural regulations and state law. In order to clarify the importance of rural regulations in the modernization of the rule of law in China, this paper discusses how to resolve the conflict between the rural regulations and the state law, and how to transform the rural regulations into the state law at the level of legislation and judicature. It explains what kind of rural regulations we need to pay attention to.
