【摘要】:在經(jīng)濟(jì)轉(zhuǎn)軌的大背景下,中國(guó)社會(huì)的貪腐猖獗、官商勾結(jié)和權(quán)力濫用等問(wèn)題也日益突出,貪腐“大案要案”時(shí)有發(fā)生,腐敗的危害性空前加劇,民眾反腐聲浪日漸高漲。本文的研究目標(biāo)直接指向探討中共執(zhí)政六十多年來(lái)初步建立反腐廉政法律法規(guī)制度體系的歷程、特點(diǎn)、經(jīng)驗(yàn)和趨勢(shì),探討在新形勢(shì)下如何建構(gòu)反腐廉政法律法規(guī)制度體系,如何實(shí)現(xiàn)黨內(nèi)立規(guī)和國(guó)家反腐立法的有效銜接與整合。在此目標(biāo)的指引下,本文以法治思維和法治方式反腐倡廉為指導(dǎo)思想,從黨史黨建、法學(xué)、政治學(xué)、社會(huì)學(xué)等多學(xué)科視角,綜合運(yùn)用歷史研究、比較研究以及實(shí)證研究等研究方法,對(duì)執(zhí)政黨反腐倡廉法制建設(shè)進(jìn)行全景式、系統(tǒng)性研究。這一研究主題將從以下五個(gè)方面展開(kāi): 第1章探討了中國(guó)共產(chǎn)黨推進(jìn)反腐廉政法制建設(shè)的主要思想資源。分別從中國(guó)傳統(tǒng)廉政制度思想與西方廉政法制思想,馬克思主義經(jīng)典作家關(guān)于反腐廉政法制建設(shè)的思想以及中國(guó)共產(chǎn)黨關(guān)于反腐廉政法制建設(shè)的思想等三個(gè)方面進(jìn)行研析。 第2章梳理和分析了改革開(kāi)放前中國(guó)共產(chǎn)黨反腐廉政法制建設(shè)的經(jīng)驗(yàn)教訓(xùn)。改革開(kāi)放前三十年,執(zhí)政黨認(rèn)為腐敗的根源主要在于封建思想余毒和資產(chǎn)階級(jí)腐朽思想的侵蝕,因此反腐敗的主要手段在于思想政治教育,開(kāi)展群眾運(yùn)動(dòng),強(qiáng)調(diào)對(duì)民眾十分關(guān)注的大案要案的審判和懲處,反腐廉政法制建設(shè)被置于相對(duì)次要的地位。 第3章總結(jié)了改革開(kāi)放以來(lái)中國(guó)共產(chǎn)黨反腐廉政法制建設(shè)的推進(jìn)、成就及存在的問(wèn)題。改革開(kāi)放以來(lái),以鄧小平為核心的黨的第二代、以江澤民為核心的第三代中央領(lǐng)導(dǎo)集體,吸取十年“文革”的慘痛教訓(xùn),審時(shí)度勢(shì),實(shí)現(xiàn)了反腐廉政建設(shè)思路的現(xiàn)代轉(zhuǎn)型,即加強(qiáng)廉政法制建設(shè),循法治思維和法治方式根治腐敗。改革開(kāi)放三十多年來(lái),反腐廉政建設(shè)開(kāi)始了從以運(yùn)動(dòng)為主的反腐到制度性的長(zhǎng)效性反腐、從重事后懲治到懲防并舉、從定點(diǎn)清除到整體性反腐的轉(zhuǎn)型,并取得了顯著的成效。但這一歷史時(shí)期仍存在著反腐廉政國(guó)家立法工作滯后于反腐廉政建設(shè)的形勢(shì);有法不依、執(zhí)法不嚴(yán),以權(quán)壓法、徇私枉法的問(wèn)題仍然存在;國(guó)家法律與執(zhí)政黨黨章、黨規(guī)的相互協(xié)調(diào)有待進(jìn)一步完善;國(guó)家司法制度與執(zhí)政黨紀(jì)檢制度的相互配合有待進(jìn)一步完善。 第4章論述了中國(guó)共產(chǎn)黨推進(jìn)反腐廉政法制建設(shè)面臨的新形勢(shì)和新問(wèn)題。黨的第十七屆中央委員會(huì)第四次全體會(huì)議指出,世情、國(guó)情、黨情的深刻變化對(duì)黨的建設(shè)提出了新的要求,當(dāng)前中國(guó)反腐廉政法制建設(shè)也呈現(xiàn)出新特點(diǎn):反腐廉政法律法規(guī)制度體系日漸嚴(yán)密、注重通過(guò)體制改革和制度創(chuàng)新懲治和預(yù)防腐敗、網(wǎng)絡(luò)反腐的興起及其制度化、加強(qiáng)反腐敗國(guó)際司法交流與合作,等等。新形勢(shì)下反腐廉政建設(shè)存在著:廉政法制建設(shè)無(wú)法同市場(chǎng)經(jīng)濟(jì)改革同步、廉政法律體系不周全、反腐廉政立法層級(jí)低、監(jiān)督機(jī)制不健全、預(yù)防機(jī)制失靈、懲處力度不夠、選擇性反腐、在反腐敗國(guó)際合作方面立法滯后等問(wèn)題。 第5章提出了新形勢(shì)下中國(guó)共產(chǎn)黨進(jìn)一步推進(jìn)反腐廉政法制建設(shè)的思考。新形勢(shì)下,要樹立法治是治國(guó)理政、約權(quán)治吏基本方式的基本理念,從如下幾個(gè)方面進(jìn)一步推進(jìn)反腐廉政法制建設(shè):第一,進(jìn)一步完善反腐敗和廉政建設(shè)法律法規(guī)制度體系。制定《反腐敗法》、《公職人員從政道德法》、《公職人員財(cái)產(chǎn)申報(bào)法》和《行政程序法》等國(guó)家反腐立法;修改完善《預(yù)算法》,建立財(cái)政預(yù)算透明機(jī)制;制定整合性的《監(jiān)督法》并切實(shí)發(fā)揮其法律效力。第二,通過(guò)體制改革和制度創(chuàng)新防治腐敗。全面推進(jìn)懲治和預(yù)防腐敗體系建設(shè),嚴(yán)格執(zhí)行黨風(fēng)廉政建設(shè)責(zé)任制,改革干部人事制度,建構(gòu)獨(dú)立的專業(yè)化的廉政反貪?rùn)C(jī)構(gòu),擴(kuò)大公眾參與和社會(huì)輿論監(jiān)督。第三,依法依紀(jì)查處腐敗案件。嚴(yán)格執(zhí)法,有腐必反;健全紀(jì)檢監(jiān)察體制,加強(qiáng)紀(jì)檢監(jiān)察機(jī)關(guān)與司法機(jī)關(guān)的分工與合作;深化司法體制改革,確保公正司法。第四,加強(qiáng)反腐敗國(guó)際司法交流與合作。 綜上所述,全面推進(jìn)反腐廉政法制建設(shè),走中國(guó)特色的反腐廉政道路,必須順應(yīng)世情、國(guó)情、黨情的深刻變化,立基于社會(huì)主義市場(chǎng)經(jīng)濟(jì)和民主政治之上,建立健全權(quán)力制約和監(jiān)督機(jī)制,教育、制度、監(jiān)督并舉,預(yù)防和懲治腐敗相結(jié)合,實(shí)現(xiàn)運(yùn)動(dòng)式反腐向法治型反腐、黨內(nèi)反腐向制度反腐的現(xiàn)代轉(zhuǎn)型,從而構(gòu)建反腐廉政的長(zhǎng)效機(jī)制。
[Abstract]:Under the background of economic transition, the corruption of Chinese society is rampant, the collusion of officials and businessmen and the abuse of power are becoming more and more prominent. The corruption "major case" has occurred, the harm of corruption is unprecedentedly intensified and the public's anti-corruption sound waves are rising. The research goal of this paper directly points to the preliminary establishment of the anti corruption and low corruption for more than 60 years in the administration of the Communist Party of China. The course, characteristics, experience and trend of the system of political and legal system, how to construct the system of anti-corruption and clean government laws and regulations under the new situation, how to realize the effective cohesion and integration of the internal Party regulations and the national anti-corruption legislation. Under the guidance of this goal, this article is guided by the guiding ideology of the anti corruption and advocacy of the rule of law by law and the rule of law, from the party history. In the multi disciplinary perspective of Party building, law, political science and sociology, the comprehensive application of historical research, comparative research and empirical research on the construction of the ruling party's anti-corruption and building a clean government is carried out in a panoramic view and systematic research. This research theme will be carried out from the following five aspects:
The first chapter discusses the main ideological resources of the Communist Party of China to promote the construction of anti-corruption and clean government legal system, including three aspects, such as the thought of Chinese traditional system of honest and clean government and the thought of the legal system of honest and clean government in the west, the thought of the construction of anti-corruption and clean government by Marx's classic writers and the thought of the Communist Party of China on the construction of the anti-corruption and low government legal system. Research and analysis.
The second chapter has combed and analyzed the experience and lessons of the construction of the anti corruption and clean government legal system of the Communist Party of China before the reform and opening up. In the first thirty years of the reform and opening up, the ruling party believed that the root of corruption mainly lies in the erosion of the feudal ideology and the corrupt thoughts of the bourgeoisie. Therefore, the main means of anti corruption are in Ideological and political education, and the mass movement is carried out. The trial and punishment of major cases that are of great concern to the public have been placed in a relatively minor position.
The third chapter summarizes the progress, achievements and existing problems of the Chinese Communist Party's anti-corruption and clean government legal system since the reform and opening up. Since the reform and opening up, the second generation of the party with Deng Xiaoping as the core, the third generation of central leading collective with Jiang Zemin as the core, the painful lessons of the "Cultural Revolution" for ten years, and the realization of the construction of anti-corruption and clean government. The modern transformation of ideas is to strengthen the construction of a clean and clean government, to cure corruption by rule of law thinking and rule of law. In the past thirty years, the construction of anti-corruption and clean government has started from the anti corruption to the systematic and long-term anti-corruption, from the serious afterthought to the punishment and prevention, from the fixed-point clearance to the overall anti corruption. The fourth chapter discusses the new situation and new problems faced by the Communist Party of China in promoting the construction of anti-corruption and clean government legal system. The fourth plenary meeting of the Seventeenth Central Committee of the CPC pointed out that the world situation, the national conditions and the profound changes in the party's situation put forward new requirements for the construction of the party, and the construction of the legal system for anti-corruption and low government in China present new characteristics: Anti-corruption and clean government. The system of laws and regulations is becoming more and more strict. It pays more attention to the punishment and prevention of corruption through system reform and system innovation, the rise and institutionalization of network anti-corruption, and the strengthening of international judicial exchanges and cooperation in anti-corruption. The fifth chapter puts forward the thinking of the Communist Party of China to further promote the construction of the anti corruption and clean government legal system under the new situation. Under the new situation, we should establish the rule of law as the basic idea of governing the country and government, the basic way of the right to govern the officials, and further promote the construction of the anti-corruption and clean government legal system from the following aspects: first, further improve the laws and regulations on the construction of anti-corruption and clean government. To sum up, the overall promotion of the construction of anti-corruption and clean government legal system and the path of anti-corruption and clean government with Chinese characteristics must comply with the world situation, the national conditions and the profound changes in the party's situation, based on the socialist market economy and democratic politics, establish and improve the mechanism of power restriction and supervision, education, system, supervision, and the combination of prevention and punishment of corruption, and the realization of the combination of the prevention and punishment of corruption.
