【摘要】：隨著我國治理新常態(tài)建設步伐的推進,原有硬法范疇的治理形式已經(jīng)被突破,軟法開始起到日益顯著的作用。在高等教育領域,大學章程是其重要的軟法形式。對大學章程進行分析,可見大學章程在屬性與效力、制定過程與爭議裁決,以及自治規(guī)范等方面都具備軟法性質(zhì)。大學治理是我國高等教育領域建設的重要內(nèi)容,而法治又是大學治理的基本形式。作為軟法性質(zhì)的大學章程之于大學治理法治化的改革與實施機制中都存在著諸多的契合點。在大學章程的建設過程中,應通過培育與弘揚大學法治理念、對權力運行規(guī)則的規(guī)范性調(diào)整及建立保障機制等方式切實實現(xiàn)大學治理的法治化。
[Abstract]:With the development of the construction of the new normal of governance in our country, the governance form of the original hard law category has been broken through, and the soft law has begun to play an increasingly prominent role. In the field of higher education, university charter is an important soft law form. From the analysis of the university charter, it can be seen that the university charter has soft law character in the aspects of attribute and effect, making process and dispute ruling, and autonomy norm, etc. University governance is an important part of the construction of higher education in China, and the rule of law is the basic form of university governance. As a soft law nature, there are many common points in the reform and implementation mechanism of university governance by law. In the process of university constitution construction, we should cultivate and carry forward the idea of university rule by law, regulate the rules of power operation and establish the guarantee mechanism to realize the legalization of university governance.
