【摘要】：堅(jiān)持中國(guó)特色社會(huì)主義法治道路的內(nèi)容之一是建設(shè)高效的法治實(shí)施體系,偵查活動(dòng)作為刑事司法領(lǐng)域一種具體的法律適用,偵查法治是提升偵查能力、確保案件得到客觀公正處理、實(shí)現(xiàn)司法公正的重要保障和必然要求。2012年刑事訴訟法修正后,法律規(guī)定對(duì)偵查法治提出了更高的要求,也給偵查機(jī)關(guān)帶來(lái)了更大的壓力和挑戰(zhàn),亟須對(duì)偵查工作進(jìn)行改革。在依法治國(guó)背景下,進(jìn)行偵查法治的相關(guān)研究是十分必要的,圍繞人權(quán)保障、程序公正和證據(jù)中心的法治理念,提出確立偵查主體的法律共同體發(fā)展方向、保障偵查措施的正當(dāng)性適用、強(qiáng)化偵查權(quán)力的私權(quán)對(duì)抗模式、完善偵查程序的公權(quán)制約機(jī)制四個(gè)方面的法治改造之路。
[Abstract]:One of the contents of adhering to the socialist road of ruling by law with Chinese characteristics is to build an efficient system of implementation of the rule of law. As a specific legal application in the field of criminal justice, the investigation of the rule of law is to enhance the ability of investigation. After the amendment of the Criminal procedure Law in 2012, the legal provisions put forward higher requirements for the investigation of the rule of law, but also brought greater pressure and challenges to the investigative organs. Under the background of ruling the country by law, it is very necessary to study the rule of law in investigation, which revolves around the concept of human rights protection, procedural justice and the rule of law in the center of evidence. This paper puts forward four ways to reform the rule of law by establishing the legal community of the subject of investigation, ensuring the legitimacy of the investigation measures, strengthening the private right confrontation mode of the investigation power and perfecting the public power restriction mechanism of the investigation procedure.
