【摘要】：馬克思把握歷史唯物主義法哲學(xué)分析原則,把法律發(fā)展現(xiàn)象置于社會變遷特別是歷史向世界歷史轉(zhuǎn)變進(jìn)程中加以觀照,著力探討法律發(fā)展的類型轉(zhuǎn)換、內(nèi)在機(jī)理、運(yùn)動樣式、價(jià)值取向等基本問題,確立了研究法律發(fā)展現(xiàn)象的理論分析工具,展示了其法律發(fā)展思想的理論邏輯力量,實(shí)現(xiàn)了法律發(fā)展理論史上的革命性變革。在全面推進(jìn)法治中國建設(shè)、實(shí)現(xiàn)中國法治現(xiàn)代化的新的時(shí)代條件下,深入研究馬克思的法律發(fā)展思想,對于揭示中國法治現(xiàn)代化進(jìn)程的社會機(jī)理,推進(jìn)國家法治與區(qū)域法治的協(xié)調(diào)發(fā)展,恪守以人民為中心的法治發(fā)展準(zhǔn)則,把握新全球化進(jìn)程中的中國法治的歷史方位,進(jìn)而探尋文明社會法治現(xiàn)代化的"中國方案",具有極為重要的理論價(jià)值與實(shí)踐意義。
[Abstract]:Marx grasped the analysis principle of legal philosophy of historical materialism, put the phenomenon of legal development in the process of social change, especially in the process of historical transformation to world history, and focused on discussing the type conversion, internal mechanism and movement style of legal development. This paper establishes a theoretical analysis tool to study the phenomenon of legal development, demonstrates the theoretical logical power of his thought of legal development, and realizes the revolutionary change in the history of legal development theory. Under the new era conditions of comprehensively promoting the construction of China under the rule of law and realizing the modernization of the rule of law in China, a thorough study of Marx's thought of legal development will reveal the social mechanism of the process of modernization of the rule of law in China. To promote the coordinated development of the rule of law in the country and the region, to abide by the people-centered rule of law development, and to grasp the historical orientation of the rule of law in China in the process of new globalization. Therefore, it is of great theoretical value and practical significance to explore the "Chinese scheme" for the modernization of civil society by law.
