【摘要】：地方行政權(quán)責(zé)關(guān)系作為橫向權(quán)力的分配及運(yùn)作問(wèn)題,是政治研究的核心問(wèn)題之一。秦代地方政務(wù)文書(shū)出土為展開(kāi)考察實(shí)踐運(yùn)作的權(quán)責(zé)關(guān)系提供空間。從日常行政與法律的視角審視,秦代縣令丞的行政職權(quán)大致分為法律授權(quán)、自主以及兩者兼有三種;行政責(zé)任分為自負(fù)責(zé)任與連坐責(zé)任,均有法律依據(jù)。秦代通過(guò)法律規(guī)范地方行政權(quán)責(zé),調(diào)整權(quán)責(zé)關(guān)系,追求權(quán)責(zé)一致,不過(guò)實(shí)踐運(yùn)作出現(xiàn)五種權(quán)責(zé)背離情況:權(quán)責(zé)的法律制度安排非對(duì)稱、法律規(guī)定責(zé)任的僵化、消極責(zé)任的問(wèn)責(zé)幅度過(guò)大、同體問(wèn)責(zé)嚴(yán)重干擾行政執(zhí)行、權(quán)責(zé)關(guān)系的皇帝導(dǎo)向引發(fā)的背離。究其根本,秦代地方行政權(quán)責(zé)關(guān)系問(wèn)題實(shí)為傳統(tǒng)地方行政與國(guó)家法治的矛盾問(wèn)題一種表現(xiàn)。
[Abstract]:The distribution and operation of local administrative power and responsibility as horizontal power, Local government documents unearthed in Qin Dynasty provide space for investigating the relationship between power and responsibility in practice. From the perspective of daily administration and law, the administrative authority of Ling Cheng in Qin Dynasty is roughly divided into legal authorization. There are three kinds of autonomy and both; the administrative responsibility is divided into conceited responsibility and even sitting responsibility, all of them have legal basis. The Qin Dynasty regulates the local administrative power and responsibility by law, adjusts the relationship between power and responsibility, and pursues the unity of power and responsibility. However, there are five deviations in practice: asymmetric arrangement of the legal system of power and responsibility, ossification of legal provisions, excessive accountability of negative responsibilities, and serious interference with administrative execution by cohort accountability. Based on the deviation caused by the emperor's guidance of the relationship between power and responsibility, the problem of the relationship between the power and responsibility of the local administration in Qin Dynasty is a manifestation of the contradiction between the traditional local administration and the rule of law in the country.
